On July 25, 2023, a coalition of booksellers, publishers, and authors sued multiple Texas government agencies seeking to enjoin a law requiring booksellers to rate books as either “sexually explicit” or “sexually relevant,” if applicable, before selling them to public schools. The suit was brought in the U.S. District Court for the Western District of Texas before Judge Alan D. Albright; the coalition sued the Texas State Library and Archives Commission, the Texas Board of Education, and the Texas Education Agency under 42 U.S.C. § 1983. Represented by private counsel, the coalition sought preliminary and permanent injunctive relief; a declaratory judgment as to the illegality of the book rating law; and costs, fees, and any other relief deemed proper. 

The coalition claimed that the law violated their free speech and due process rights under the First and Fourteenth Amendments. In particular, the requirement to rate books before sale coupled with the Texas Education Agency’s ability to unilaterally amend any ratings constituted compelled speech, unconstitutional prior restraint, and an unconstitutional delegation of government authority. The coalition also claimed that the definitions of “sexually explicit” and “sexually relevant” were unconstitutionally overbroad and vague, and challenged the law both facially and as-applied. 

On September 18, 2023, the district court granted the plaintiffs' motion for a preliminary injunction and denied defendants' motion to dismiss, which they had filed on August 19. The court agreed with the plaintiffs that the Texas law constituted unconstitutional compelled speech by forcing booksellers to adopt ratings they do not agree with. Moreover, the court agreed with the coalition’s argument that the terms “sexually explicit” and “sexually relevant” were unconstitutionally vague, as was the law’s exemption for material “directly related to the curriculum.” Finally, the court held that speech regulation that could be altered unilaterally by an official—without opportunity for appeal—lacked sufficient safeguards to render the regulated speech sufficiently constitutional as a prior restraint. 

The same day the district court issued its opinion, defendants appealed to the U.S. Court of Appeals for the Fifth Circuit. Shortly after, on September 25, 2023, the Fifth Circuit issued an administrative stay of the lower court’s decision pending the outcome of the appeal. On November 29, 2023, a three-judge panel heard oral argument. As of December 10, 2023, the Fifth Circuit had not yet issued an opinion in this case.
