In January of 2022, the school board for the Wentzville R-IV School District in Missouri removed eight critically acclaimed books from the shelves of the school library. Each of the banned books features and presents the perspective of an author or protagonist, or both, who is non-white, LGBTQ+, or otherwise identifies as a minority.

In response to the removal of the banned books from their school library, two minor students attending public schools in the Wentzville R-IV school district, by and through their parents, filed this lawsuit in the United States District Court for the Eastern District of Missouri on February 15, 2022. The plaintiffs named Wentzville R-IV School District as the sole defendant and alleged that the defendant removed the banned books with the intent and purpose of preventing students from accessing ideas or opinions disliked by policymakers, school officials, community members, or a combination of those, in violation of the First Amendment. Represented by the ACLU of Missouri, plaintiffs sought declaratory relief, preliminary and permanent injunctive relief, and attorneys’ fees. This case was assigned to District Judge Matthew T. Schelp.

On March 14, 2023, plaintiffs filed a motion for preliminary injunction asking that the court direct the defendant to return the banned books to school libraries and enjoin the defendant from removing any other library material while the case proceeded. Plaintiffs argued that they had a substantial likelihood of succeeding on the merits of their case because the First Amendment right to access information and ideas is at its peak in school libraries. Furthermore, plaintiffs contended that the school’s policy—allowing parents to make a formal complaint against library material that they found “objectionable in any manner,” whereby school officials were required to remove the material for every student—amounted to an unconstitutional “heckler’s veto.” Plaintiffs argued that defendants cannot consistently with the First Amendment suppress speech because others might react negatively to it. They further argued that they and other students at their school would be irreparably harmed without a preliminary injunction because the school policy violated their First Amendment rights and stigmatized the banned materials and the students who chose to read them.

The school district filed their opposition to plaintiffs’ motion for preliminary injunction on March 28, 2022. They argued that the plaintiffs overstated students’ First Amendment rights to access information in school libraries while understating the discretion granted to school boards to determine what material to include in school libraries. Defendants further argued that plaintiffs had failed to demonstrate that the school board had removed banned books solely or primarily due to a dislike of the viewpoints expressed in those books.

On August 5, 2022, the district court denied plaintiffs’ motion for preliminary injunction. The court was persuaded by the school district’s opposition brief, finding that the defendant’s policy or action had not clearly violated the students’ First Amendment rights in the way plaintiffs claimed, and that plaintiffs had failed to present sufficient evidence to show that the school board had removed banned books solely or primarily due to a dislike of the viewpoints expressed in those books. 619 F.Supp.3d 906.

Plaintiffs appealed the judge’s decision to the United States Circuit Court for the Eighth Circuit on September 2, 2023 (22-2885). Per the parties’ request, the district court stayed the case pending the appeal.

Throughout the course of the litigation, the defendant ultimately returned seven of the eight banned books to the school libraries. For this reason, on January 13, 2023, plaintiffs asked the Eighth Circuit to dismiss their appeal, and the Eighth Circuit dismissed the appeal on January 17, 2023. The district court lifted the stay on the case on January 24, 2023, and on February 8, 2023, plaintiffs moved to voluntarily dismiss their case. On February 23, 2023, the district court dismissed the case, and this case is now closed.
