This is a case about whether the University of Florida and the state of Florida may shut down a student group based on speech expressed by an affiliated but distinct national organization. On November 16, 2023, the University of Florida chapter of Students for Justice in Palestine (UF SJP), represented by the ACLU, the ACLU of Florida, and Palestine Legal, filed a lawsuit challenging an order to deactivate the student group on campus issued by the Chancellor of the State University System of Florida, in consultation with Governor Ron DeSantis. The order claimed that the UF SJP were in violation of the state’s material support for terrorism statute because of an email sent by the National Students for Justice in Palestine (NJSP) group. The complaint, filed under 42 U.S.C. § 1983 in the United States District Court for the Northern District of Florida, alleged that the Chancellor’s order violated the First Amendment of the U.S. Constitution because it constituted censorship, viewpoint discrimination, and a burden on the freedom of association. The complaint alleged that the order provided no basis for attributing NJSP’s speech to the UF group, and, even if it did, the speech itself was protected by the First Amendment. The plaintiffs sought a declaratory judgment, preliminary and permanent injunctions, and attorneys' fees. The case was assigned to Chief Judge Mark E. Walker.

On December 22, 2023, the defendants moved to dismiss the case on various grounds, including that the plaintiffs lacked standing to sue. On February 1, 2024, the court dismissed all the defendants. First, the court held that the plaintiffs lacked standing to sue Governor Desantis because they failed to allege that a court order would actually redress their injuries, as the Governor lacked authority to take any action related to the Chancellor's order that would impact the plaintiffs. 2024 WL 2866543. Second, the court held that the plaintiffs lacked standing to sue the university defendants because their alleged injuries—related to the chilling of speech and the threat of UF JSP being deactivated—did not appear imminent, and there was no evidence presented that the university was going to deactivate UF JSP. 2024 WL 2705566. The court therefore dismissed the case and denied the motion for preliminary injunction. 2024 WL 374543.

This case is now closed.
