San Antonio-based software company DigitalDesk and its president, represented by the Wisconsin Institute for Law & Liberty (WILL), filed suit against Bexar County and a nonprofit that supports small business loans in the U.S. District Court for the Western District of Texas on July 17, 2023. The plaintiff alleged that his company was denied funding through a county pandemic assistance program because he is a white man. He sued under 42 U.S.C. §§ 1983 and 1985, alleging a violation of (and a conspiracy to violate) his rights under the Fourteenth Amendment's Equal Protection Clause, and under 42 U.S.C. § 1981, alleging racially discriminatory contracting practices. The plaintiff sought declaratory and injunctive relief, compensatory and punitive damages, and attorneys' fees. U.S. District Court Judge Jason K. Pulliam was assigned to the case. 

In early 2023, Bexar County rolled out its assistance program for small businesses, providing grants to eligible companies impacted by the pandemic. The plaintiff applied for a grant on January 6, 2023. According to the complaint, Bexar County created a “scoring methodology” to prioritize grant applications, which included race-based and sex-based considerations. A San Antonio-based nonprofit, which offers small business loans and technical support to small businesses, implemented and administered the county program. The organization was named in the suit alongside Bexar County. 

On May 23, 2024, the court granted the defendants’ motion to dismiss, holding that the plaintiff lacked standing to sue. The program required applicants to submit specific eligibility documents, including filed business tax returns for 2019 and 2020. The court noted that when the plaintiff applied for the program, he submitted an unfiled tax return for 2020—a fact that plaintiff did not contest. Because the plaintiff was otherwise ineligible for the program, the allegedly discriminatory scoring methodology caused him no harm, and his deficient application was not enough to provide a basis for standing. Although the IRS accepted the plaintiff’s 2020 return a few weeks after his application was submitted, the court noted that the plaintiff did not argue that this filing cured any eligibility deficiency or otherwise provided a basis for standing. Moreover, by the time the suit was filed, the application period had passed and the program had ended as all funds had been exhausted. And so, the plaintiff could not demonstrate a likelihood of future injury, as he was no longer eligible to apply. 2024 WL 2420810.

On June 21, 2024, the plaintiff appealed the decision to the U.S. Court of Appeals for the Fifth Circuit. Oral argument was held on April 1, 2025, and the case is ongoing as of May 2025.
