This is a case about incarcerated individuals experiencing overcrowding in their cells. This class action lawsuit was filed on January 21, 2020, contending that the chronically overcrowded conditions of the Allen County Jail in Indiana violates the inmates' rights under the Eighth and Fourteenth Amendments. This action was brought under the 42 U.S.C. § 1983. The plaintiff, a man held at the Allen County Jail,  was represented by ACLU of Indiana and private counsel. The plaintiff sued the sheriff of Allen County, Indiana. The plaintiff alleged the Jail had 741 operational beds but often housed more than 800 prisoners. Detainees allegedly without beds slept on mattresses on plastic platforms called “boats”, sometimes near toilets, and this led to fights among detainees.

The plaintiff requested certification of a class of all persons confined or would in the future be confined in the Allen County Jail. The plaintiff also requested a declaratory judgement, permanent injunction requiring defendants to take all steps necessary to ensure that the conditions of confinement at the Allen County Jail comply with the Constitution, and attorney’s fees. The case was assigned to Judge Damon R Leichty and Magistrate Judge Susan Collins.

On March 9, 2020, the plaintiff filed a stipulation to certify the case as a class action. This motion, along with the initial request for a class action, was approved by the court on March 17, 2020. The certified class included all persons at the time currently confined, or who will in the future be confined, in the Allen County Jail.

The parties took part in multiple mediation conferences starting January 26, 2021. 

On August 23, 2021, the plaintiff filed a motion for summary judgement. He argued that the risk of violence caused by overcrowding, the lack of staff, and the failure to provide sufficient recreation violates the Eighth and Fourteenth Amendments of the Constitution.

The plaintiff filed a motion for oral argument on November 11, 2021. This motion was granted on November 16, 2021, and the oral argument was held on December 16, 2021.

On March 31, 2022, the court granted the plaintiff’s request for summary judgement and request for a permanent injunction. The court found that the jail’s conditions violated the Eighth and Fourteenth Amendments because of the dangerous housing situations, lack of recreation, and increase in violence among detainees. Further, the court found the balance of hardships and public interest favored an injunction because of the risk to public safety. The permanent injunction required the defendants to develop a long-term solution for overcrowding, increase staffing levels, and provide detainees with at least three hours of recreation per week. The court also required the defendant to submit a plan within 45 days with specific steps to solve the constitutional violations, and to provide monthly reports on progress.

The plaintiff filed a motion for attorneys’ fees on May 27, 2022, which was approved by the court on June 16, 2022.

The parties filed multiple status reports throughout late 2022 to 2024. Construction on the jail building is expected to be completed in Spring 2027.

As of March 2025, monitoring is ongoing.

OPINION AND ORDER: The court GRANTS the class's summary judgment motion (ECF 40 ), their motion for leave to reply to the objections to the proposed factual findings and order (ECF 59 ), and the request for a permanent injunction.Accordingly, the court ORDERS that defendants are permanently enjoined to take all necessary and appropriate steps as outlined in the order. The court will conduct a status conference on June 16, 2022 at 1:30 p.m. in a Fort Wayne courtroom. The parties to comply with all deadlines as outlined in the opinion and order. This court DIRECTS entry of final judgment for the class and against the defendants accordingly.
