Two licensed marriage and family therapists brought this lawsuit individually and on behalf of their patients against the City of Boca Raton and the County of Palm Beach, Florida in the U.S. District Court for the Southern District of Florida on June 13, 2018. The plaintiffs challenged City Ordinance 5407 and Palm Beach County Ordinance 2017-046 (“the ordinances”), both of which prohibited conversion therapy on minors, on federal constitutional grounds and state constitutional and statutory grounds. They claimed that the ordinances violated their right to free speech, right to receive information, and their right to free exercise under the First Amendment. They further claimed that the ordinances violated several provisions of the Florida Constitution and the Florida Religious Freedom Restoration Act. The plaintiffs sought declaratory relief, a preliminary and permanent injunction preventing enforcement of the ordinances by the defendants, nominal damages, actual damages, a declaration of rights and legal relations concerning the subject matter of the controversy, and costs and attorneys’ fees. The case was assigned to Judge Robin Lee Rosenberg. 

The plaintiffs initially filed a motion for a preliminary injunction on June 14, 2018, but the court dismissed that motion without prejudice and required the plaintiffs to serve their complaint first and then renew their motion. The plaintiffs renewed their motion on June 22, 2018. On August 1, 2018, the defendants filed a motion to dismiss for failure to state a claim. 

On February 13, 2019, the court denied the plaintiffs’ motion for a preliminary injunction. The court concluded that the plaintiffs did not meet their burden of demonstrating a substantial likelihood of success on the merits or irreparable injury for the purposes of a preliminary injunction. The plaintiffs appealed the district court’s decision to the U.S. Court of Appeals for the Eleventh Circuit that same day. The parties orally moved to stay the case in the district court, and the court issued an order staying the case on February 19, 2019. 

On November 20, 2020, the Eleventh Circuit reversed the district court’s denial of a preliminary injunction to the plaintiffs. 981 F.3d 854. The court rejected the argument that the ordinances regulate professional conduct, not speech, and it found that the ordinances discriminated on the basis of viewpoint. Accordingly, the court determined that the ordinances violated the First Amendment guarantee of free speech. The court remanded the case to the district court to issue a preliminary injunction consistent with its opinion. The defendants filed a petition for rehearing en banc, which was denied.  

On August 4, 2022, the plaintiffs filed a motion asking the district court to lift the stay and issue a preliminary injunction. The plaintiffs said that they would seek emergency relief from the Eleventh Circuit if the delay went beyond 5 p.m. on August 15, 2022.  On August 11, 2022, the court issued a paperless order saying that its delay was not a denial, and it said it would rule on the motion as soon as its resources permitted it to do so. On August 15, 2022, the district court had still not ruled, and the plaintiffs filed a motion to the Eleventh Circuit merits panel to enforce its mandate. The Eleventh Circuit construed the motion as a writ of mandamus, and it granted plaintiffs petition for a writ of mandamus, directing the district court to enter a preliminary injunction by 5 p.m. on August 19, 2022. On August 18, 2022, the district court lifted the stay and entered a preliminary injunction enjoining the defendants from enforcing the ordinances pending the resolution of the merits action. 

The plaintiffs filed their first amended complaint on October 28, 2022. The plaintiffs added their claim that the defendants had conspired to violate the plaintiffs’ First Amendment rights in violation of 42 U.S.C. § 1985(3). Furthermore, the defendants had purported to repeal the ordinances, but the plaintiffs argued that the repeal was not genuine and the case was not moot because the defendants were continuing to express hostility toward the plaintiffs’ beliefs and intended to continue chilling the plaintiffs’ First Amendment rights. 

On November 10, 2022, the defendants filed a motion to dismiss the plaintiffs’ first amended complaint for failure to state a claim and for lack of jurisdiction. 

The parties subsequently settled their claims, and the court entered final judgment in favor of the plaintiffs on April 6, 2023. In its final judgment, the court said that the defendants would pay the plaintiffs a total of $175,000, to be divided among the plaintiffs as laid out in the final judgment. The court also said that it would retain jurisdiction to determine attorneys’ fees and costs in subsequent proceedings. The court then issued a paperless order closing the case on April 11, 2023. 

The parties continued to file motions regarding attorneys’ fees and costs after the court entered its judgment. On January 17, 2024, the court granted in part and denied in part the plaintiffs’ motion for attorneys’ fees. The plaintiffs appealed the district court’s decision to the Eleventh Circuit, and the defendants cross-appealed. Those appeals are still pending in the Eleventh Circuit as of April 23, 2025.
