On January 19, 2024, four Howard County Jail prisoners, represented by the ACLU of Indiana, filed suit against the Howard County Jail in the U.S. District Court for the Southern District of Indiana. The complaint alleged the facility’s chronic overcrowding violated the plaintiffs’ Fourteenth Amendment rights as applied to pretrial detainees and the Eighth Amendment rights as it applied to convicted detainees. The plaintiffs sought declaratory and injunctive relief from the court. The case was assigned to the Chief Judge Tanya Walton Pratt.

The complaint alleged that the jail routinely houses more prisoners than there are available beds — requiring many to sleep on the floor. The plaintiffs alleged that assaults and fights were frequent, due to spacing issues and lack of recreation outside cell areas. Additionally, the complaint noted that cells were unsanitary and damp due to plumbing leaks, forcing prisoners to place their bedding on wet floors. Each individual plaintiff filed grievances through the Jail’s internal administrative system relating to issues stemming from the facility’s overpopulation. 

On April 29, 2024, the court certified the class consisting of “all persons currently confined, or who will in the future be confined, in the Howard County Jail.” 

On January 10, 2025, the parties submitted to the court a private settlement agreement, containing both long-term and short-term solutions. First, the agreement stipulated that the defendants must notify the plaintiffs by May 1, 2025, with details regarding the construction of an additional jail, including the facility's size and occupancy capacity. In addition, the settlement purported that all possible efforts would be made to keep the existing jail population below 292. The agreement set in place a corrective mechanism if this number is exceeded for long periods of time. The settlement also included provisions for recreational time for all inmates within the facility. Additionally, both parties agreed that the defendants would submit a progress report every 90 days, outlining significant developments. Lastly, the defendants agreed to pay $15,000 in attorneys' fees and costs to class counsel.

The settlement has not yet been evaluated by the court for compliance with the rules governing class action resolutions, and no fairness hearing has been held.
