This case challenged Jefferson County’s policy of denying prescribed medication for opioid use disorder (MOUD) to non-pregnant individuals incarcerated at the Jefferson County Correctional Facility. This case was part of a broader trend of litigation expanding access to evidence-based treatment for incarcerated individuals with opioid use disorder (Godsey v. Sawyer, Strickland v. George W. Hill Correctional Facility, Spurlock v. Wexford). 

On March 1, 2022, M.C. and T.G., two individuals who were in or faced detention in the Jefferson County Correctional Facility, filed a class action lawsuit in the U.S. District Court for the Northern District of New York before District Judge David N. Hurd. Represented by the New York Civil Liberties Union Foundation, the plaintiffs sued Jefferson County, its Sheriff, Undersheriff, and Jail Administrator. The suit challenged the jail’s categorical ban on methadone and buprenorphine for detainees with opioid use disorder, except for pregnant individuals, alleging violations of the Eighth and Fourteenth Amendments, the Americans with Disabilities Act (ADA), and the New York State Human Rights Law. Specifically, plaintiffs alleged that the County’s policy constituted deliberate indifference to serious medical needs and discrimination on the basis of disability.The plaintiffs sought declaratory and injunctive relief, attorneys’ fees, and class certification on behalf of all non-pregnant individuals who were denied prescribed MOUD while detained. That same day, plaintiffs filed a motion to certify the class. 

On March 2, 2025, Judge Hurd granted a Temporary Restraining Order, requiring the jail to provide M.C.'s prescribed methadone treatment; soon after, on March 29, the Judge extended the order to a preliminary injunction. On May 16, 2022, the court certified the class and extended the injunction to all class members, finding plaintiffs were likely to succeed on their ADA and constitutional claims. The order held that denying prescribed methadone and buprenorphine posed a substantial risk of serious harm and lacked any legitimate penological justification.

Following discovery and settlement negotiations, the parties reached a proposed agreement requiring the jail to provide evidence-based MOUD (methadone and buprenorphine) to all incarcerated individuals with valid prescriptions upon entry, regardless of pregnancy status. The proposed consent decree also mandated staff training and compliance monitoring.

Judge Hurd granted preliminary approval of the settlement on April 24, 2024, and scheduled a fairness hearing. After that hearing was held on August 28, 2024, the court entered a final judgment and consent decree on August 29, 2024, granting plaintiffs’ motion for final approval and holding that the decree was “fair, adequate, and reasonable” under Rule 23(e)(2), met the standards of Kozlowski v. Coughlin, 871 F.2d 241 (2d Cir. 1989), and complied with the Prison Litigation Reform Act (PLRA). The order also approved $352,310.10 in attorneys’ fees and costs as reasonable and directed the clerk to close the case. Importantly, the court retained jurisdiction to enforce the consent decree throughout its implementation period, ensuring ongoing oversight of Jefferson County’s compliance with the decree’s terms.

As of October 2025, the consent decree remains in effect, requiring the Jefferson County Correctional Facility to maintain MOUD access, staff training, and compliance reporting to ensure continued protection of the class’s medical and disability rights. Specifically, the consent decree detailed the Jail’s requirements in verifying or assessing MOUD treatment, detainees’ rights to request MOUD treatment and to continued treatment, and the Jail’s responsibility in release planning for individuals receiving MOUD treatment.

MEMORANDUM-DECISION and ORDER granting Dkt. # 31 Motion for Preliminary Injunction; and granting Dkt. # 2 Motion to Certify Class: plaintiffs motion for class certification is GRANTED. Plaintiffs claims are certified as a class action on behalf of a class defined as: all non-pregnant individuals who are or will be detained at the Jefferson County Correctional Facility and had or will have prescriptions for agonist medication for opioid use disorder at the time of entry into defendants custo dy, as well as two subclasses, one each for class members subject to pretrial and postconviction custody, respectively. Named plaintiffs M.C. and T.G. are appointed as class representatives and the New York Civil Liberties Union Foundation is appoint ed as class counsel. In addition, plaintiffs motion for a preliminary injunction on behalf of the class is GRANTED. Pending a final decision on the merits of this action, it is ORDERED that defendants are immediately PRELIMINARILY ENJOINED to provide plaintiffs and the now-certified class with agonist medication for opioid use disorder during their detention in defendants custody in accordance with the requirements set forth in New York Correction Law § 626.
