On November 8, 2022, a resident and voter in Rocky Ford, Colorado, filed this complaint pro se in the Western District of Colorado alleging violations of voting administration. Plaintiff filed suit against the State of Colorado, the Otero County Commissioner's Office, the La Junta Clerk & Recorder, City Manager of Rocky Ford, the R2 School Board and Administration, the Rocky Ford Gazette, the Colorado Governor's Office, and the La Junta Commissioner's Office, alleging a violation under 18 USC 371, 18 USC 1341, 18 USC 1343, 18 USC 1961, and the RICO statute. Mr. Navarro alleged that the City of Rocky Ford failed to publish in their newspapers or on mail voting ballots the on homeowners, which he alleged was a violation of the Voting Rights Act of 1965.

On November 17, 2022, the Court issued an order that in order for the action to proceed, Plaintiff must either pay the filing fee or be granted leave to proceed in forma pauperis. On December 5, 2022, Plaintiff filed an Application to Proceed in District Court without Prepaying Fees or Costs.

 On January 26, 2023, the Court issued an order stating venue for the violations raised by Mr. Navarro was improper and since Mr. Navarro had already filed a similar case in his home-state district court, the Court declined to transfer this action. The case was closed the same day.
