On October 11, 2022, two men, each a well-known Black comedian, actor, and writer, filed suit against Clayton County, Georgia, the Chief of the Clayton County Police Deparmtent (CCPD), several members of the CCPD, and an investigator of the Clayton County District Attorney’s office in the U.S. District Court for the Northern District of Georgia challenging the CCPD’s operation of an interdiction program at Atlanta’s Hartsfield-Jackson International Airport. The complaint, brought pursuant to 42 U.S.C. § 1983 and Section 1981 of the Civil Rights Act of 1866, 42 U.S.C. § 1981, asserted four causes of action: (1) a § 1983 claim by both plaintiffs against all defendants alleging unlawful seizure in violation of the Fourth and Fourteenth Amendments; (2) a § 1983 claim by one of the two plaintiffs against the County, the chief of police, and three of the named CCPD officers alleging unlawful search in violation of the Fourth and Fourteenth Amendments; (3) a § 1983 claim by both plaintiffs against all defendants alleging a violation of the Equal Protection Clause of the Fourteenth Amendment; and (4) a § 1981 claim by both plaintiffs against all defendants. Represented by the Policing Project at the New York University School of Law and private counsel, the plaintiffs sought declaratory relief, compensatory damages, punitive damages, and pre- and post-judgment interest and an award of the costs of the action. The matter was assigned to District Judge Mark Howard Cohen.

This case concerns the operations of the CCPD’s specialized Airport Interdiction Unit known as the “Clayton County Narcotics Unit-Airport Investigations Group,” which seeks to combat drug trafficking by placing armed officers in the jet bridge of departing domestic flights to conduct randomized, “consensual” encounters with passengers boarding their flights in an attempt to identify passengers carrying illegal drugs or large amounts of currency. The two plaintiffs in this case were pulled aside, interrogated, and searched as part of this program–one in October 2020 and the other in April 2021. According to the complaint, the stops rely on coercion, rather than consent, and targets are selected disportionately based on their race, rather than at random. The complaint contained information from CCPD’s records, which showed that from September 2020 through April 2021, 56 percent of the passengers stops where race was recorded were Black, despite only eight percent of American airline passengers being Black. CCPD records also showed that over that same eight-month span, the jet bridge stops resulted only in charges against two passengers and the seizure of fewer than 0.08 pounds of illegal drugs. On the other hand, officers seized more than $1 million from passengers interdicted as part of the program, all but one of whom were ultimately permitted to board their flight and continue travel. The complaint alleged that the seizures did not “meaningfully combat” drug trafficking, but instead provided a “financial windfall” for CCPD.

On November 11, 2022, the individual named defendants collectively filed a motion to dismiss based on insufficient service of process and lack of personal jurisdiction and, separately, a motion to stay all discovery pending resolution of the motion to dismiss. The motions were mooted as a result of a the individual defendant’s returning signed waivers of service to plaintiffs’ counsel and ultimately dismissed.

The plaintiffs filed an amended complaint on December 30, 2022, in which they provided additional background on the jet bridge program before the 2019 stop of the first defendant in this case. In doing so, the amended complaint provided details concern the interdiction of two other Black passengers, one in 2017 and one in 2019, that the plaintiffs asserted illustrated the “routine and longstanding nature” of customs and policies that allowed for “coercion and racial profiling” in interdictions, often for financial gain. The amended complaint also included reference to a 2016 case, Noell v. Clayton Cnty., in which the court held that “suspicionless jet bridge stops and searches violate Fourth Amendment rights.” This, the plaintiffs asserted, had put CCPD on notice that its policies and procedures governing jet bridge stops violate the Fourth Amendment.

The individual named plaintiffs filed another motion to dismiss and motion to stay on January 17, 2023. Judge Cohen issued an order on September 5, 2023, granting the motion to dismiss and directing the clerk to close the case. In his order, Judge Cohen held the plaintiffs’ Fourth Amendment claims failed because their interactions with the officers were voluntary in nature. Judge Cohen held the plaintiff’s equal protection claim failed because the complaint did not plausibly allege either a similarly situated comparator or a discriminatory effect. He also found that even if the plaintiffs had sufficiently alleged both, there was no “plausible allegation” that the defendants “purposefully discriminated against them.” In dismissing the § 1981 claim, Judge Cohen held that because such a claim is predicated on a valid underlying constitutional violation, and because he found no such violation to exist in dismissing the first three counts, the § 1981 claim too must fail. And because this claim fails, Judge Cohen held that Clayton County must be dismissed as a defendant. In his opinion, Judge Cohen laid out several additional grounds for dismissal: (1) official capacity claims against the named officials were duplicative of the claims against Clayton County; (2) the individual named defendants were entitled to qualified immunity for the claims against them in their individual capacities; (3) because there were no constitutional violations, the Chief of Police could not be held liable under a theory of supervisory liability; and (4) the plaintiffs’ derivative claims for declaratory relief failed because all constitutional violations were dismissed and the plaintiff’s claims for punitive damages also failed as a matter of law.

On October 3, 2023, the plaintiffs appealed the district court’s order granting the motion to dismiss to the U.S. Court of Appeals for the Eleventh Circuit. There, a number of notable individuals and organizations petitioned to file amicus briefs on the plaintiffs’ behalf, including: the Institute for Justice, the NAACP Legal Defense & Education Fund; The Cato Institute; the Law Enforcement Action Partnership and numerous current or former law enforcement officials; and a group of prominent Black members of the entertainment industry–Tyler Perry, Jamie Foxx, Taraji Henson, Sterling K. Brown, Rege-Jean Page, Yahya Abdul Mateen, Michael Ealy, Antoine Fuqua, Kemp Powers, and Jodie Turner-Smith.

As of February 2025, the appeal remains pending before the Eleventh Circuit.
