This case involved alleged retaliation for protesting by Lawrence, Kansas police officers. On April 22, 2003, a private citizen and self-identified civil rights activist filed this lawsuit in the U.S. District Court for the District of Kansas against the City of Lawrence and both city and state officials under 42 U.S.C. § 1983. Initially pro se (though later represented by private counsel), the plaintiff alleged that the City and the police violated his First and Fourth Amendment rights when they took retaliatory action against the plaintiff for protesting and recording police officers. More specifically, he alleged retaliation for his protests of traffic stops through fabricated charges and that the City of Lawrence maintained an unconstitutional policy in its police force of encouraging officers to prohibit or impede First Amendment rights. The plaintiff sought equitable relief. The case was assigned to Judge John W. Lungstrum.
