This lawsuit, filed on January 26, 2023, challenged the conditions of confinement for people incarcerated on Texas's death row. The four named plaintiffs, all death row inmates in the Allan B. Polunsky Unit Prison operated by the Texas Department of Criminal Justice (TDCJ), alleged the blanket policy of solitary confinement for all male death row prisoners restricted their access to medical care, their ability to meet confidentially with their attorneys, and caused severe physical and mental harm. Plaintiffs sued the Executive Director of TDCJ, the Director of the Correctional Institutions Division of TDCJ, and the Warden of the Allan B. Polunsky Unit. Represented by private counsel, the plaintiffs brought this action under 42 U.S.C. § 1983 for violations of the Sixth Amendment, Eighth Amendment, Fourteenth Amendment, and Texas state law. The plaintiffs sought to certify as a class of all male death row prisoners incarcerated in permanent solitary confinement at the Polunsky Death Row Unit. They also sought a declaratory judgement, permanent injunctive relief preventing the defendants from violating their Sixth, Eighth, and Fourteenth Amendment rights, compensatory damages, punitive damages, and attorney’s fees.

The case was assigned to Judge Lynn N. Hughes.

On January 30, 2023, the case was transferred to the Eastern District of Texas because the Polunsky Unit was in that district. The case was referred to Magistrate Judge Zack Hawthorn the next day.

The defendants filed a motion to dismiss on March 30, 2023, alleging that the plaintiffs lacked standing and that the official-based claims are barred by Eleventh Amendment sovereign immunity. Further, the defendants claimed that the court lacked jurisdiction to provide relief under 18 U.S.C. § 3599. The defendants also claimed that the plaintiffs failed to state a constitution claim. Last, defendants argued that  injunction and damages were barred by the Prison Litigation Reform Act. The motion was stricken on March 30 for unknown reasons. 

On May 11, 2023, the plaintiff filed an amended complaint that added one named plaintiff and added details about mold in the plaintiffs’ cells. 

The defendants filed another motion to dismiss on July 10, 2023. This motion contained most of the same arguments as the first motion to dismiss. The defendants also alleged that some, but not all, of the plaintiffs lacked standing regarding the mold, food, and recreation related claims.

A motion to intervene was filed pro se by an individual incarcerated at the Powledge Unit at Polunsky on November 15, 2023.

On March 28, May 6, and August 1, 2024, additional motions to intervene were filed by the same pro se individual. He added additional exhibits of evidence with each motion.

The court denied all four motions by the intervenor on August 16, 2024, finding that he was incarcerated in a different unit of the prison, and it would be difficult for him to communicate with the other plaintiffs and their counsel.

As of February 2025, this case is ongoing.
