This is a class-action lawsuit against the Department of Veterans' Affairs for allegedly failing to provide sufficient housing to veterans in L.A. County.

On November 15, 2022, fourteen unhoused veterans with severe disabilities sued VA Secretary Denis Richard McDonough as well as several senior VA officials for the Los Angeles region in the U.S. District Court for the Central District of California. Represented by the public interest law firm Public Counsel, the plaintiffs sued under the Rehabilitation Act of 1973 (which prohibits discrimination on the basis of disability by federal programs and contractors), the Administrative Procedure Act, and common law breach of fiduciary duty. The plaintiffs alleged that the VA failed to provide adequate housing services at their 388-acre campus in West L.A. The case was initially assigned to District Judge Ronald S. W. Lew.

Previously, several unhoused veterans filed a 2011 lawsuit, Valentini v. Shinseki, alleging similar claims against the VA regarding its management of the VA campus in West L.A.  In Valentini, the parties reached a settlement agreement that would provide for 1,200 units of permanent housing on the West LA VA Grounds, with 750 complete by 2022. The VA also committed to primarily "veteran-focused" land use on the campus.

The plaintiffs here brought five types of claims. The first three were under the Rehabilitation Act: the plaintiffs alleged that the VA 1) denied “meaningful access” to benefits due to insufficient housing on the West LA VA campus, 2) failed to provide integrated care, which created a serious risk of institutionalization (an Olmstead claim), and 3) facially discriminated by contracting with developers who considered a veteran’s disability benefits when calculating income, thus excluding some disabled veterans from housing. Fourth, the plaintiffs asserted a breach of fiduciary duty claim, alleging that West LA VA campus constituted a charitable trust and that the government had violated their duty to veterans by entering into land-use agreements with third parties that were not related to benefitting veterans. Finally, the plaintiffs asserted an Administrative Procedure Act (APA) claim that the third-party leases violated a federal statutory requirement to principally benefit veterans.

On May 12, 2023, the case was reassigned to Judge David O. Carter. On May 15, 2023, the plaintiffs amended their complaint to make it a class action. On May 3, 2024, the court granted the plaintiffs' motion for class certification, creating a class of "[a]ll homeless veterans with Serious Mental Illness or Traumatic Brain Injuries who reside in Los Angeles County" and a subclass of those who make over 50% of the local median income. 732 F.Supp.3d 1184.

In May, June, and July 2023, various defendants moved to dismiss the case. The American Civil Liberties Union subsequently filed an amicus brief in support of the plaintiffs' argument that the court had jurisdiction to hear their case. The court denied all the motions to dismiss on December 14, 2023. The court held that it had jurisdiction over the plaintiffs' claims because the Veterans Judicial Review Act, which prevents district court judicial review in some cases, did not apply here. The court also held that the plaintiffs had plausibly alleged each of their claims. 713 F.Supp.3d 695.

The following year, on April 5, Bridgeland Resources, a company that operated oil wells on the VA campus, filed a complaint in intervention seeking to stop the plaintiffs from getting an injunction to force VA to void its land-use agreement with Bridgeland.

On July 14, 2024, Judge Carter granted in part the plaintiff's motion for summary judgment and denied defendant's motion for summary judgment. Judge Carter found that the L.A. VA’s practice of leasing of campus land to third-party developers who employed income limitations facially discriminated against veterans based on their disabilities under the Rehabilitation Act. Judge Carter explained that the defendants largely did not dispute the existence of the policy, and that disability benefits disqualified some veterans from adequate housing. On the meaningful access claim, the Olmstead claim, the breach of duty claim, and the APA claim, Judge Carter determined that the issues would be best determined by a trier of fact. 2024 WL 3416249.

The court's bench trial began on August 6, 2024 and ended on August 30, 2024. A week later, on September 6, Judge Carter entered judgment in favor of the plaintiffs. Judge Carter held that the plaintiffs had established Rehabilitation Act violations by showing a denial of services and reasonable accommodations to access their healthcare needs and that the plaintiffs' proposed 1,800 units expansion constituted a reasonable modification. With regard to the land use claims - breach of fiduciary duty and violation of the APA - Judge Carter found that the VA had an obligation to retain the West LA VA Grounds as a veteran-focused site, and that third-party leases to institutions like UCLA and the Brentwood School contravened that obligation. 2024 WL 4100866.

Judge Carter entered a permanent injunction on October 11, 2024, ordering the defendants to create 750 temporary units within eighteen months and, within six months, submit a plan to build 1,800 permanent units in the next six years. Judge Carter further ordered the VA to increase staffing for its housing waiver program. Additionally, Judge Carter held that the VA's land use agreements with the Brentwood School, Safety Park, Bridgeland, and UCLA were void, and ordered the defendants not to enter land use agreements that were not for the benefit of veterans. The court appointed two monitors, John Hueston and Michelle Martinez, to track the defendants' compliance with the injunction.

Later that month, on October 18, the parties moved for approval of a settlement between the plaintiffs and Brentwood School, under which Brentwood would continue operating but would pay $5 million to a VA housing fund and provide programs and services for veterans.

Various parties and non-parties appealed the district court's permanent injunction to the Ninth Circuit Court of Appeals: the defendants (case no. 24-6576), the UCLA Board of Regents (case nos. 24-6338 and 24-6603), Bridgeland (case no. 24-6578), and Brentwood (case no. 24-6888).

On November 8, 2024, the Ninth Circuit stayed the district court's injunction until the Ninth Circuit had fully heard the defendants' motion for a stay pending appeal. The district court denied the defendants' motion for a stay soon after, on November 13, but the Ninth Circuit had yet to rule on the issue as of December 29, 2024.
