The Illinois General Assembly enacted the Tamara Clayton Expressway Camera Act in 2019 following the shooting of a U.S. postal worker named Tamera Clayton on an expressway in suburban Chicago as she made her way to work. Pritzker signed “Tamara Clayton 2.0,” which extended the Act and allowed for cameras to be installed in 21 other…

The Illinois General Assembly enacted the Tamara Clayton Expressway Camera Act in 2019 following the shooting of a U.S. postal worker named Tamera Clayton on an expressway in suburban Chicago as she made her way to work. In implementing the Act, some 300 automated license plate reader (ALPR) cameras were installed across the expressways within Cook County. In June 2022, Governor J.B. Pritzker signed “Tamara Clayton 2.0,” which extended the Act and allowed for cameras to be installed in 21 other counties as well as along Lake Shore Drive in Chicago.

On May 30, 2024, two residents of Cook County, Illinois, filed suit against the State of Illinois alleging for use of these ALPR cameras, alleging that they “subject[] every citizen who relies on a car or truck for transportation, including Plaintiffs, to unwarranted, suspicionless dragnet surveillance.” Represented by the Liberty Justice Center, the plaintiffs specifically alleged that the use of these cameras to track their movements constituted a violation of their Fourth and Fourteenth Amendment rights against unreasonable searches. The plaintiffs sought a court order to enjoin the implementation of the Tamera Clayton Expressway Camera Act and to enjoin the defendants from operating the existing system of ALPRs to track the plaintiffs and from installing additional ALPRs that would track the plaintiffs if they continued to drive cars in Illinois.

The case was assigned to District Judge Martha Pacold, who then sent the case to Magistrate Judge Jeannice Appenteng for further proceedings. The plaintiffs filed a motion requesting a preliminary injunction on August 20. In response, the defendants filed a motion to dismiss on September 10 alleging the court lacked subject-matter jurisdiction and that the plaintiffs had failed to state a claim. 

This case is ongoing as of September 2024.
