This is a putative class-action lawsuit about parole practices in Alabama. Three people incarcerated in Alabama filed this lawsuit on August 8, 2024, alleging that the Alabama Department of Corrections routinely incarcerated people past their release dates instead of releasing them on parole. The plaintiffs, who were represented by the MacArthur Justice Center and private counsel, named ten defendants: current and past members of the Department of Correction’s Executive Leadership team, and current and past members of the Board of Pardons and Parole, including the Director of the Bureau of Pardons and Parole. The plaintiffs filed their complaint in the U.S. District Court for the Northern District of Alabama. 

The plaintiffs alleged that a 2015 Alabama law referred to as the “Mandatory Release Law” required that eligible incarcerated people would be released three to twelve months early, with the end of their prison sentence turning into supervised release. However, the plaintiffs alleged that the defendants' policies did not follow the mandatory language of the law and instead gave the defendants discretion to decide whether each person should be released. The plaintiffs brought this lawsuit under 42 U.S.C. § 1983, claiming that the defendants were detaining plaintiffs longer than the law allowed, in violation of their Fourteenth and Eighth Amendment rights to substantive due process and freedom from cruel and unusual punishment. The plaintiffs also brought state tort claims of false imprisonment and negligence. Further, the plaintiffs alleged that an amendment to the Mandatory Release Law that delayed the release time for people sentenced before the law's passage violated the Ex Post Facto Clause of the U.S. Constitution by retroactively increasing people's sentences. 

Plaintiffs sought to represent a class of people currently or previously in the custody of the Alabama Department of Corrections who were or are entitled to mandatory release under the Mandatory Release Law but were not released by their mandatory release date. They also sought to represent a subclass of people whose release times were retroactively delayed by the Mandatory Release Law amendment. The plaintiffs sought a declaration that the defendants’ practices violated the U.S. Constitution and Alabama law; nominal, compensatory, and punitive damages; and attorneys' fees. The case was initially assigned to Judge Liles C Burke, but later reassigned to Judge Corey L. Maze.
