This is a case about a Nevada school district that allegedly failed to provide sufficient special education. On September 25, 2024, several Nevada students with disabilities filed this putative class action lawsuit in United States District Court for the District of Nevada. Represented by private attorneys and Council of Parent Attorneys and Advocates (COPAA), the students sued the State and Clark County School District (CCSD) under the Individuals with Disabilities Education Act (IDEA), Section 504 of the Rehabilitation, and Title II of the Americans with Disabilities Act (ADA). The students sought declaratory and injunctive relief. 

The students in the case alleged systemic deficiencies that were revealed in a commissioned review of special education services by the Council of Great City Schools (CGCS Review). The students alleged that CCSD maintained policies that prevented special education students and potential special education students from accessing services and resources:

  • CCSD instructed general education teachers to not tell parents that their children may need an evaluation.
  • CCSD refused to provide reasonable accommodations for students with dyslexia, behavioral management needs, and autism.
  • CCSD maintained policies failing to provide appropriate supports to ensure that children are educated in the Least Restrictive Environment (LRE).
  • CCSD ignored staffing shortages and disproportionately used long-term substitutes, non-certified staff, and paraprofessionals to provide services to students with disabilities, resulting in a denial of free and appropriate public education (FAPE) and a lack of access to the least restrictive environment.

The case was assigned to Judge Gloria M. Navarro on September 26, 2024. Plaintiffs amended their complaint on December 10, 2024. Additional plaintiffs were added, but no new claims were added. The case is currently pending in front of Judge Navarro.
