This is a class action lawsuit alleging that the Beverly Hills Police Department engaged in systemic racial profiling and employed unconstitutional policing practices against Black Americans. 

On July 15, 2024, two Black men filed this lawsuit in the U.S. District Court for the Central District of California seeking to represent a class of Black individuals who were detained or arrested by the Beverly Hills Police Department ("BHPD") without being convicted of any crime.  Represented by private counsel, plaintiffs sued the City of Beverly Hills, the Chief of Police, a BHPD officer, and ten anonymous employees of BHPD. 

Plaintiffs brought claims under 42 U.S.C. § 1983 for violations of the Fourth and Fourteenth Amendments, as well as related state-law civil rights claims under the Bane Act for false arrest and imprisonment. Specifically, plaintiffs alleged that the defendants unlawfully and unreasonably detained them without reasonable suspicion or probable cause, and that those actions were motivated by their race. Furthermore, plaintiffs alleged that they had been arrested without a warrant, and that the arrests were intentional and the seizures were unreasonable. In addition, they alleged violation of their procedural and substantive due process rights through malicious prosecution and false imprisonment. Finally, plaintiffs brought claims for alleged violation of their Equal Protection rights on the basis that the City of Beverly had a widespread pattern and practice of racial profiling. The plaintiffs sought monetary damages and injunctive relief. The case was assigned to Judge Fernando M. Olguin.

On October 3, 2024, plaintiffs filed an amended complaint, changing the makeup of the class based on the date of prosecution. The original proposed class was composed of individuals prosecuted from June 1, 2022 through June 1, 2024. The amended complaint proposed instead a class of individuals prosecuted from July 15, 2022 onwards. 

On November 4, 2024, the City filed a motion to dismiss, arguing that the class was overly broad and inadequately defined, and that plaintiffs failed to plead sufficient facts to establish discriminatory intent or malicious prosecution.and not necessary.

On February 25, 2025, plaintiffs filed a second amended complaint refining factual allegations and identifying additional individual officers as defendants. On March 27, 2025, the court dismissed claims and class allegations to the extent they sought to represent or obtain relief for individuals who had been convicted of offenses arising from their encounters with the Beverly Hills Police Department. The court concluded that the operative complaint impermissibly swept in convicted individuals, whereas plaintiffs’ theory of liability and class framing were limited to people detained, arrested, or prosecuted without resulting convictions. Because the complaint did not plausibly support claims on behalf of convicted persons, the court struck those allegations and dismissed those portions of the case. 

Plaintiffs filed objections and oppositions in early April 2025, and the court addressed these filings through a series of rulings and minute orders during April. On April 25, 2025, the magistrate judge entered a protective order to govern discovery. The court subsequently issued orders addressing these objections and scheduling further proceedings.

From May through the fall of 2025, the docket reflects continued motion practice, attorney substitutions, discovery-related disputes, and orders resolving issues such as scheduling, subpoenas, and various objections. Several hearings were continued or decided on the papers. As of November 2025, the case is ongoing in pretrial discovery and motion practice.
