The Fair Housing Center of Central Indiana (FHCCI) and an individual who resided in Indianapolis, Indiana (together, “plaintiffs”) brought this lawsuit against Tricon Residential, Inc. (Tricon), Tricon American Homes LLC, and TAH Holding LP (together, “defendants”) in the U.S. District Court for the Central District of California Southern Division on November 20, 2024. The named plaintiff was a black man who applied to rent a Tricon home and was denied due to prior criminal convictions, despite some of those convictions being expunged or incorrectly reported. He brought this lawsuit on behalf of himself and all others similarly situated, and he asked for the court to certify a nationwide class of all black applicants who were otherwise qualified to rent with Tricon but were automatically rejected from tenancy based on Tricon’s criminal history policy on or after January 1, 2015. The plaintiffs claimed that Tricon’s criminal history policy, under which Tricon automatically refused housing to individuals with certain criminal records, violated both the Fair Housing Act (FHA) and the California Fair Employment and Housing Act (CFEHA). The plaintiffs also claimed that Tricon’s Eviction Filings Policy, under which Tricon automatically refused housing to individuals with prior eviction filing records, violated the same two statutes. The plaintiffs sought declaratory relief, a permanent injunction enjoining Tricon from continuing its discriminatory conduct and directing them to take affirmative steps to remedy the effects of their conduct and prevent future similar conduct, compensatory and punitive damages, and reasonable attorneys’ fees and costs. The case was assigned to Judge David O. Carter on November 21, 2024. 

The plaintiffs filed their first amended complaint on January 21, 2025. The amended complaint named only one defendant– TAH operations LLC, which was a subsidiary of Tricon and which set and implemented the policies regarding tenant criteria and applicant screening at all of Tricon’s single-family rental homes in the U.S. The plaintiffs' claims, however, did not change. On the same day, the plaintiffs also filed a request for private mediation, and the court ordered the case to a private mediator on February 20, 2025. 

The case is ongoing as of April 21, 2025.
