This case challenges the change in school names that evoke discriminatory messages of Black inferiority and subjugation. In Shenandoah County of Virginia, there are two schools named “Stonewall Jackson High School” and “Ashby Lee Elementary School” in honor of two Confederate military heroes. These schools were renamed to reflect racial inclusivity in 2021. However, in 2024, the Shenandoah County School Board restored their original names.

On June 11, 2024, the Virginia State Conference NAACP and several black students who are attending or planning to attend these schools filed this lawsuit in the United States District Court, Western District of Virginia, Harrisonburg Division. Represented by Washington Lawyers’ Committee
for Civil Rights and Urban Affairs and a private law firm, the plaintiffs sued the County School Board of Shenandoah County, arguing that the reinstatement of these names violates the First and Fourteenth Amendments, Title VI of the Civil Rights Act of 1964, and the Equal Educational Opportunities Act. The plaintiffs also challenged the school athletic team name, “Stonewall Jackson Generals,” and the team mascot. The plaintiffs sought to remove the Confederate names and mascots and to prevent any future naming involving Confederate leaders, attorneys’ fees, and litigation costs. The case was assigned to Chief Judge Elizabeth Dillon, but, on July 3, it was transferred to Judge Michaeal Urbanski.

On July 17, 2024, the defendant filed a motion to dismiss for failure to state a claim, which was denied on January 22, 2025. The court reasoned that the plaintiffs plausibly alleged that reinstating Confederate school names in 2024 may violate the First and Fourteenth Amendments, Title VI, and the Equal Educational Opportunities Act. The court found sufficient claims of compelled speech, discriminatory intent, and disparate impact on Black students, warranting discovery to further assess the defendant’s motives and the harms alleged.

As of April 15, 2025, the case is ongoing.
