On April 4, 2024, a group of three immigration attorneys and two individual plaintiffs filed a class action complaint in the U.S. District Court for the Northern District of California. The plaintiffs filed this lawsuit against U.S. Customs and Border Protection (CBP) and the U.S. Department of Homeland Security (DHS). The group sought class certification, declaratory and injunctive relief, and attorney’s fees under the Freedom of Information Act (FOIA), 5 U.S.C. § 552. The plaintiffs asked the court to declare the defendants’ conduct to violate the FOIA, and issue permanent injunctions ordering them to make determinations on their pending FOIA requests and require them to make FOIA determinations within 30 business days for future requests as mandated by the FOIA. The plaintiffs are represented by National Immigration Litigation Alliance and the Northwest Immigrant Rights Project. The case was initially assigned to Judge Trina Thompson.


The case arose after the plaintiffs individually submitted FOIA requests. The information the plaintiffs sought in their requests were related to their clients’ records to permit the attorney’s to adequately advise their clients, and their own immigration history to permit them to apply for visas or other benefits. The defendants allegedly consistently failed to meet the statutory requirements in responding to FOIA requests, and routinely deny nearly all expedited FOIA requests. Due to the defendants’ practices and backlog of FOIA requests, the proposed class would consist of individuals who filed, or will file, FOIA requests with CBP for their individual records which have been pending, or will be pending with CBP for more than 30 business days without determination. 


On July 15, 2024, the defendants moved to transfer or dismiss the complaint. In response, the plaintiffs filed an amended complaint on August 2, 2024. In their amended complaint the plaintiffs added one individual plaintiff, and two further claims against the defendants. In addition to their original FOIA claim, the plaintiffs made two claims under the Administrative Procedure Act (APA), 5 U.S.C § 706. They claim that the defendants’ actions unlawfully withheld or unreasonably delayed required actions, which constituted arbitrary and capricious action in violation of the APA.


In their revised motion to transfer or dismiss filed on August 16, 2024, the defendants sought to dismiss the claims for lack of subject matter jurisdiction and improper venue, and failure to state a claim against DHS. The defendants claimed that the special forum provision in the FOIA made the District of Columbia the “all purpose, universal venue for FOIA lawsuits” capable of hearing the claims of all plaintiffs in the case. They also sought dismissal of the claims against DHS because the complaint did not allege that the plaintiffs submitted any FOIA requests to DHS.

On November 4, 2024, the court granted the defendants’ motion to dismiss or transfer. The court dismissed the plaintiffs’ APA claims against all defendants for lack of subject matter jurisdiction because the FOIA grants courts the power to grant declaratory and injunctive relief, foreclosing APA relief. Next, the court dismissed the FOIA claim against DHS because the plaintiffs did not allege that they submitted any FOIA requests to DHS. FInally, the court went on to find that venue in California was not proper because the FOIA requires venue to be proper for each claim and party. It ordered the case, and remaining FOIA claims against CBP, to be transferred to the U.S. District Court for the District of Columbia. The transferred case was assigned to Judge Howell. 


On January 31, 2025 the plaintiffs filed a motion to reconsider dismissal of their FOIA claim against DHS. They argue that the transferor court erroneously analyzed their FOIA claims as individual claims rather than as a policy or practice claim. In the alternative, the plaintiffs seek to have their APA claims reinstated to ensure they have a remedy against DHS which is responsible for CBP.

This case is ongoing.
