This case challenged the State of Louisiana alleged racial gerrymander in its creation of a majority-African American voting district (CD6).

On January 30, 2024, a group of individual non-African American voters residing in Louisiana filed this lawsuit against the Louisiana Secretary of State in the Western District of Louisiana. Plaintiffs alleged that Louisiana’s new redistricting bill, SB8, segregated voters based entirely on their races through its creation of two majority-African American voting districts and four majority non-African American districts. Plaintiffs filed suit under 42 U.S.C. § 1983, alleging that SB8 constituted racial gerrymandering in violation of Equal Protection under the Fourteenth Amendment (Count I). Plaintiffs further alleged that SB8, by imposing an “obvious” racial preference when redistricting, abridged their right to vote in violation of the Fourteenth and Fifteenth Amendments (Count II). Plaintiffs requested a three-panel judge pursuant to 28 U.S.C. § 2284(b)(1). Represented by private counsel, Plaintiffs requested declaratory relief, an injunction barring Louisiana from using SB8’s map of congressional districts for any election and instituting a congressional districting map that remedied such violations, and all fees and costs. The case was assigned to Judge David C Joseph and Magistrate Judge Kayla D McClusky. 

The order granting the three-judge panel was granted on February 2, 2024. 

On February 6, 2024, a group of individual voters in Louisiana (“Galmon Movants”) filed a motion to intervene as Defendants. These individuals were Plaintiffs in the case Galmon v. Ardoin, No. 3:22-cv-00214-BAJ-RLB (M.D. La. Mar. 30, 2022), in which they argued that Louisiana’s old electoral map violated Section 2 of the Voting Rights Act (“VRA”) because it failed to include a second district where Black Louisianians would have an opportunity to elect their candidates of choice (referred to as a “Black-opportunity district”). After two years of ongoing litigation, on January 22, 2024, in response to the Galmon Movant’s various successes in the District and Circuit courts, the Louisiana legislature enacted the new districting plan SB8 that made Congressional District 6 the state’s second Black-opportunity district. This new districting plan, SB8, became the redistricting plan central to the Callais complaint. The Galmon Movants thus filed the motion to intervene, arguing that the Callais case would not exist but for the Galmon case. The Galmon Movants argued they had an interest in the Callais case, since it sought to undo the very issue being litigated in the Galmon case.

The following day, a group of Black Louisiana voters and civil rights organizations (“Robinson Movants”) filed a motion to intervene as Defendants. The Robinson Movants were Plaintiffs in the case Robinson, et al. v. Landry, No. 3:22-cv-02111-SDD-SDJ (M.D. La.), in which they argued, like the Galmon Movants, that the Louisiana electoral map violated Section 2 of the VRA and sought to compel Louisiana to adopt a congressional district map with two districts that would give Louisiana’s Black voters an equal opportunity to elect candidates of their choice. Robinson Movants alleged that any changes to the SB8 map that may result from decisions in the Callais case would directly implicate the relief that the Robinson Movants had sought and secured in the Robinson case. As such, the Robinson Movants argued they had a “strong interest in defending the Robinson courts’ core factual findings and legal conclusions against the claims in this case that SB8—or any other congressional map with two majority-Black districts—represents an unconstitutional racial gerrymander.”

In addition to the motion to intervene, the Robinson Movants requested that the Callais case be transferred to the Middle District of Louisiana, where the Robinson case was active. 

Plaintiffs filed motion for preliminary injunction on the same day, seeking to enjoin Defendant from implementing the congressional redistricting map set out in SB8 to administer any elections and order Defendant to implement their own congressional redistricting map in future elections.

Another Defendant filed a motion to intervene on February 20, 2024. The State of Louisiana (“State Defendant”) filed a motion to intervene, arguing that its intervention was necessary as a matter of right to defend the newly enacted congressional plan. Further, the State Defendant argued that without intervention, the outcome of the case would impair the State Defendant’s ability to protect its interests, and it would impair the Attorney General from carrying out her constitutional duties to defend and uphold the laws of the State of Louisiana.

On February 26, 2024, the district court issued an opinion regarding the three intervenor groups’ motions to intervene. The court granted the Robinson Movants’ motion to intervene in a limited capacity. Specifically, the court allowed them to intervene when, or if, the litigation entered any remedial phase, where the court would enjoin the use of SB8. If litigation entered the remedial phase, it would implicate the main objective in the Robinson case (the creation of the Black-majority Congressional district of CD6 under SB8), and as such, the Robinson Movants would be permitted to intervene. The court denied the Galmon Movants’ motion to intervene, since these movants shared the same interests as the Robinson Movants, and their interests would be adequately represented by the Robinson Movants in any remedial phase. The court granted the State Defendant’s motion to intervene because the State Defendant had “compelling interest” in defending SB8 created and passed by its legislators.

The Galmon Movants and Robinson Movants filed separate amicus curiae briefs in opposition to the motion for preliminary injunction on February 29, 2024. 

The Galmon Movants filed a motion for reconsideration regarding the district court’s denial of their motion to intervene on March 1, 2024. The Robinson Movants also filed a motion for reconsideration regarding the court’s intervention order on March 9, 2024. The district court denied the Galmon Movants’ motion for reconsideration but granted the Robinson Movants’ motion for reconsideration on March 15, thus allowing the Robinson Movants to participate in the initial phase of the case. The court maintained that the Galmon Movants’ interests were adequately represented by the Robinson Movants. 

The Galmon Movants appealed the denial of the motion for reconsideration to the United States Court of Appeals for the Fifth Circuit on March 15, 2024 (docket no. 24-30177). 

The case went to trial in April 2024. After trial, on April 30, 2024, the district court issued an injunction and reasons for judgment. The district court found that District 6 of SB8 violated the Equal Protection Clause and enjoined Defendant from using SB8 in any future elections. 

The following day, the Robinson Movants appealed the April 30th injunction to the Supreme Court of the United States (24-110). The Robinson Movants filed a motion to stay the injunction pending the appeal. The court denied the stay on May 3, 2024. 

The same day, the court sua sponte reconsidered its order denying the Galmon Movants’ motion to intervene. It granted the Galmon Movants’ motion to intervene but limited the intervention to the remedial phase only. 

On May 7, 2024, the parties entered the remedial phase of the litigation. The district court gave each party, intervenors, and amici a week to submit a congressional redistricting proposal (limited to one map per party). 

The same day, the State Defendant appealed the injunction to the United States Supreme Court (24-109). Later that day, the State Defendant filed an amended appeal, adding the Secretary of State Defendant.

The Defendants filed a motion to stay the injunction pending appeal, which the court denied on May 9th. 

The Galmon Movants also filed an appeal of the injunction and denial of motion for reconsideration to the United States Supreme Court. The motion was filed on May 30, 2024. 

On September 3, 2024, the States of Alabama, Georgia, Idaho, Indiana, Iowa, Mississippi, Montana, Nebraska, South Carolina, Tennessee, Texas, Utah, and West Virginia filed an amici curiae brief in support of no party. The amici argued that the “States need[ed] clarity” about the current vague interpretation of Section 2 and asked the court to “remind lower courts to interpret Section 2 like any other law.” The amici asked that the Court clarify the meaning of Section 2 in either affirming or remanding the lower court’s judgment. 

On November 11, 2024, the Supreme Court consolidated the Robinson Movants’ appeal with the State and Secretary of State Defendants’ appeal under the docket no. 24-109 (case no. 23A1142). 

On December 23, 2024, the United States filed an amicus curie brief in support of neither party. The United States urged the court to vacate and remand because the district court applied an incorrect legal standard in holding that CD6 failed strict scrutiny. The United States argued that a “state need only have a strong basis in evidence to conclude that Section 2 requires a remedial district,” which the United States alleged had been proven in the Robinson case for the creation of CD6. As such, the United States claimed that the district court should have asked whether CD6 substantially addressed the Section 2 violation identified in Robinson. Because the district court did not undertake that analysis, the Court should remand to allow the district court to apply the correct standard. In furtherance of its support, the United States filed a motion for leave to participate in the oral argument as amicus curiae in January. 

On December 6, 2024, the District of Columbia, and the states of New York, California, Colorado, Connecticut, Delaware, Hawaii, Illinois, Maine, Maryland, Massachusetts, Minnesota, Nevada, New Jersey, Oregon, Pennsylvania, Rhode Island, Vermont, Washington, and Wisconsin filed an amici curiae brief in support of Defendants. They argued that the district court failed to recognize that SB8 was created in direct response to an earlier finding by a different federal district court in Robinson, where the court found that the previous redistricting plan violated Section 2 of the VRA and required an additional majority-Black district to remedy the violation. The district court’s opinion here deprived Defendant “of the flexibility that States need to craft remedial redistricting plans.” As such, the amici asked the court to reverse the judgment. 

Days after the United States filed this motion, President Trump was inaugurated. In response to the change in administration, on January 24, 2025, the Solicitor General, on behalf of the United States, filed a letter to the Supreme Court stating that its amicus brief no longer represented the position of the United States and withdrew its motion to participate in oral argument. This is aligned with the Trump Administration's reversal of Biden-era DOJ litigation.

On January 28, 2025, the States of Alabama, Georgia, Idaho, Indiana, Iowa, Mississippi, Montana, Nebraska, South Carolina, Tennessee, Texas, Utah, and West Virginia filed a new amici curiae brief in support of Plaintiffs. Alleging largely the same analysis as their September 3rd brief, the amici asked that the court affirm the lower court’s decision. 

The Supreme Court heard oral argument on March 24. A final order is pending.
