This is a case challenging Florida's Senate Bill 266, which bans public universities from spending state or federal money on diversity, equity, and inclusion programs and bans courses that teach “identity politics” or “distort significant historical events.” On January 16, 2026, six professors from Florida’s public universities—represented by the ACLU of Florida and private counsel—filed a lawsuit in the U.S. District Court for the Northern District of Florida against the Florida Board of Governors of the State University System (BOG). The plaintiffs sued under 42 USC § 1983, alleging that SB 266 1) violates the First Amendment by imposing viewpoint-based restrictions and chilling speech, and 2) is void for vagueness under the Fourteenth Amendment’s Due Process Clause. They also alleged violations of Florida state law. In their complaint, the plaintiffs sought injunctive and declaratory relief, as well as attorney’s fees. Judge Mark Walker was assigned to the case. 

According to the complaint, the Florida legislature passed SB 266, which bans the funding of expression that “[a]dvocate[s] for diversity, equity, and inclusion, or promote[s] . . . political or social activism,” in 2023. State lawmakers delegated authority to the BOG for defining relevant terms of the statute. The BOG’s regulations define specific categories for courses to qualify for statewide general education designation, and the implementation of SB 266 has led to numerous courses being stripped of that status. As a result, academic departments face financial uncertainty, while faculty members experience increased administrative burdens and psychological stress. The named plaintiffs in the suit are all professors at Florida public universities whose work has been affected by the new statute, such as by removal of general education status for their courses or denial of funding request to attend and present at international research conferences. 

The complaint asserted that SB 266 amounts to viewpoint discrimination under the First Amendment, as it prohibits otherwise generally available funding for viewpoints disfavored by the State — such as for topics related to diversity, equity, and inclusion. The plaintiffs also alleged that the statute is overbroad, as it is not narrowly tailored and fails to provide any specifications or guidelines. Further, the complaint asserted that the statute should be void for vagueness under the Fourteenth Amendment, as its ambiguous language leaves too much room for individual interpretation. Finally, the plaintiffs alleged that SB 266 runs afoul of the state’s Campus Free Expression Act, which states that public Florida Universities are barred from “shield[ing] students, faculty, or staff from expressive activities.”

On April 2, 2025, the court denied the plaintiffs' motion for a preliminary injunction, finding that the plaintiffs failed to identify evidence showing that they face an imminent threat of suffering a redressable injury, and so lacked standing. Regarding loss of funding, the court held that the plaintiffs did not demonstrate any specific injury, but rather pointed to speculative concerns about future plans that have not materialized. Additionally, in addressing concerns about the exclusion of general education courses, the court emphasized that none of the University professors claimed that they were planning to regain general education course status in the future or that they are censoring the content of their teachings. Although acknowledging that concerns about the future of academic departments is “understandable,” the court found that the plaintiff’s claims of injury were too remote and speculative. 

As of April 2025, the case is ongoing.
