On January 10, 2025, the United States Department of Justice (DOJ) filed this lawsuit against Airbnb and an individual owner of a rental property in the United States District Court for the Northern District of California. The case was brought in relation to a complaint filed by a family that was declined for rental of an Airbnb property because the family included three minor children. The DOJ alleged that Airbnb's policy of permitting Airbnb hosts to refuse to house children violated the Fair Housing Act as discrimination on the basis of familial status. The DOJ requested relief in the form of damages for complainants and injunctive and declaratory relief.

On August 21, 2020, complainants filed an administrative complaint with the US Department of Housing and Urban Development (HUD) alleging that Airbnb discriminated against them on the basis of familial status. HUD completed an investigation of the complaint and determined that reasonable cause existed to believe that Defendants violated the Fair Housing Act. On October 16, 2024, HUD authorized the DOJ to commence this civil action.

The case was assigned to Magistrate Judge Kandis A. Westmore. The case was then reassigned to District Judge Charles Breyer because not all parties had consented to magistrate judge jurisdiction.

On June 6, 2025, the parties filed a stipulation to dismiss the individual defendant pursuant to a settlement agreement. Following Judge Breyer’s recusal, the case was reassigned to District Judge Edward M. Chen. On June 10, 2025, Judge Chen granted the dismissal, leaving Airbnb as the remaining defendant.

On June 6, 2025, Airbnb filed a motion to dismiss for improper venue and sought transfer to the Northern District of Alabama. Following a hearing, Judge Chen denied the motion to dismiss and the request for transfer, holding that the venue was proper because Airbnb allegedly implemented the challenged policy in the jurisdiction, was headquartered in that jurisdiction, and no evidence suggested that decisions were made elsewhere. 

The DOJ filed an amended complaint in March 2026 with new factual allegations, including a more detailed account of the complainant’s interactions with Airbnb. The complaint also  incorporated a new section describing other discriminatory property listings across various cities, transforming the case from a single-incident complaint to one establishing a pattern or practice of discrimination. Accordingly, the government added a new cause of action under 42 U.S.C. § 3614(a) for "pattern or practice of resistance" and expanded its requested relief to include damages for other aggrieved persons and civil penalties.

For reasons stated on the record and herein, the Court denies Defendants motion to dismiss under Rule 12(b)(3) and transfer under 28 U.S.C. § 1404. Venue is proper in this district under 28 U.S.C. § 1391(b)(2) because Airbnb allegedly implemented the policy decision at issue from here. That Airbnb is headquartered in this district, and no evidence was presented suggesting Airbnbs policy and operational decisions were made elsewhere, gives rise to a fair inference that a substantial part of the events... giving rise to the claim occurred in this district. This is sufficient to carry Plaintiffs initial burden on establishing venue. As to transfer, Airbnb points to a potential key witness in Alabama beyond the subpoena power of this Court. However, Plaintiff has offered evidence that the Alabama witness actually resides and California. Moreover, a significant portion of other evidence is located in this district.
