On January 10, 2025, the United States Department of Justice filed this lawsuit against Airbnb and an individual owner of a rental property in the United States District Court for the Northern District of California. The case was brought in relation to a complaint filed by a family that was declined for rental of an Airbnb property because the family included three minor children. The DOJ alleged that Airbnb's policy of permitting Airbnb hosts to refuse to house children violated the Fair Housing Act as discrimination on the basis of familial status. The DOJ requested relief in the form of damages for complainants and injunctive and declaratory relief.

On August 21, 2020, complainants filed an administrative complaint with the US Department of Housing and Urban Development (HUD) alleging that Airbnb discriminated against them on the basis of familial status. HUD completed an investigation of the complaint and determined that reasonable cause existed to believe that Defendants violated the Fair Housing Act. On October 16, 2024, HUD authorized the DOJ to commence this civil action.

The case was assigned to Magistrate Judge Kandis A. Westmore. This lawsuit is ongoing as of February 23, 2025.
