The PARS Equality Center (a non-profit dedicated to serving immigrants) filed a complaint on behalf of themselves, 13 Iranian American families, and beneficiaries of the families’ immigration benefits in the Northern District of California against the U.S. Secretary of State and the Acting Deputy Assistant Secretary and Managing Director for Visa Services Bureau of Consular Affairs. Filed on January 1, 2024, the plaintiffs sought declaratory and injunctive relief, as well as a writ of mandamus, to cease preventing the collection of Form DS-5535, a form including supplemental questions for visa applicants prior to their visa interviews. By implementing this so-called “DS-5535 Scheme” and preventing Iranian immigrant visa applicants from submitting DS-5535 forms prior to their interviews, the final adjudication of plaintiffs' visa applications were unreasonably delayed. Thus, the complaint alleged violations of the Administrative Procedure Act (“APA”); specifically, that the Scheme was arbitrary and capricious, an unlawful withholding of agency action, and contrary to the text of the Immigration and Nationality Act that “visa applications shall be reviewed and adjudicated by a consular officer.” The plaintiffs claimed that the DS-5535 Scheme should not give the government a workaround for the congressionally mandated duty to review and adjudicate visa applications. The plaintiffs, thus, sought mandamus relief to compel the final adjudications of their visa applications. The case was assigned to Susan Illston. 

The defendants filed a motion to dismiss on March 5, 2024. The defendants claimed that the complaint should be dismissed as moot because each of plaintiffs’ visa applications were refused under the INA. Thus, the plaintiffs had no further relief to claim according to the government. 

Numerous petitioner plaintiffs and beneficiary plaintiffs voluntarily dismissed the case as it related to them. This ultimately left the organization, three petitioner plaintiffs, and three beneficiary plaintiffs in the case. 

On November 11, 2024, Judge Illston partially granted and partially denied the defendants’ motion to dismiss. As to the first allegation of arbitrary and capricious agency action, the court noted that the agency has broad discretion in setting the “form and manner” for the immigrant visa application, meaning the government could make its own choices regarding when and how to collect the DS-5535 information. The order further explained how there was no judicially manageable standard for judging how and when the agency should exercise its discretion with respect to collecting or not collecting DS-5535. Thus, the court dismissed the arbitrary and capricious claim. Given that this claim was dismissed, the court noted that the sole count that tied the remaining plaintiffs’ claims made it reasonable to sever the claims of the plaintiff families who did not reside in the district. As for the remaining claims regarding unlawful withholding and unreasonable delays, the court rejected the defendants’ arguments. The court found the remaining claims to not be moot as the pace of processing a visa application is not entirely discretionary. Thus, those claims proceeded with regard to the two remaining individual plaintiffs. 2024 WL 4700636. 

The severed plaintiffs and their claims were then transferred to the District Court for the District of Columbia (1:24-cv-03169). The remaining plaintiffs then filed a motion for summary judgment on December 17, 2024. 

However, upon a stipulation of dismissal, Judge Illston ordered that the case be dismissed with prejudice on February 24, 2025. As the stipulation was filed under seal, the reasons for dismissal are unknown. The case is considered closed.
