This case is about the transfer of credible fear interviews in the asylum process being transferred from the U.S. Citizenship and Immigration Services to U.S. Customs and Border Protection.

On October 2, 2019, two immigration related organizations filed this lawsuit in the U.S. District Court for the District of Columbia. The plaintiffs brought this lawsuit seeking declaratory and injunctive relief against the U.S. Department of Homeland Security (DHS), U.S. Customs and Border Protection (CBP), and U.S. Citizenship and Immigration Services (USCIS) under the Freedom of Information Act (FOIA), 5 U.S.C. § 552. The plaintiffs sought orders for the defendants to conduct a search for records responsive to their FOIA request filed in 2019, an order in the alternative to make a determination on the request records and produce responsive records, an injunction against the defendants improperly withholding records, declare the defendants’ failure to conduct an adequate search violates FOIA, and award them attorneys fees. The case was assigned to Judge Rudolph Contreras.

These claims arose after USCIS, the agency tasked with conducting credible fear interviews in the asylum process, shifted responsibility to CBP at the direction of President Trump through DHS. Credible fear interviews evaluate whether an individual seeking asylum has a “credible fear” of persecution in their home country; it is the baseline inquiry into whether an individual could establish eligibility for asylum. The plaintiffs submitted FOIA requests to DHS seeking records regarding changes to, or planned changes related to the transfer of authority that occurred after President Trump took office in May, July, and August 2019 but the defendants failed to provide a response within the statutory timeframe mandated by law.

On May 19, 2021, the defendants filed a motion for summary judgment on the grounds that they satisfied all obligations required by the plaintiffs’ requests, and they were withholding some documents pursuant to statutory FOIA Exemptions. The plaintiffs filed a cross-motion for summary judgment on June 18, 2021 on the grounds that the defendants failed to meet their burden to justify withholding records, and that they failed to show that a reasonable search was conducted. On March 11, 2022, the court granted in part and denied in part the defendants’ motion for summary judgment, and granted in part and denied in part the plaintiffs’ cross-motion for summary judgment. The court denied the defendants motion asserting some of the documents requested fell under an exemption for “inter-agency or intra-agency memorandums or letters that would not be available by law to a party other than an agency in litigation with the agency.” The results of the court’s memorandum opinion was an order for the defendants to conduct a search reasonably calculated to uncover all relevant documents from the FOIA requests, supplement their justifications for exemption, and produce the disputed documents for in camera review. 

On July 29, 2022, the parties filed a joint motion to stay briefing on the renewed motions for summary judgment and motion for reconsideration because the parties were continuing to explore a potential settlement. The joint motion for stay was granted on August 1, 2022.

On April 3, 2023, the court denied the defendants’ motion for reconsideration that was stayed as moot and ordered the defendants to turnover three remaining documents to the plaintiffs due to insufficient justification for their exemption after in camera review.

Afterwards, the parties stipulated to dismiss the lawsuit with prejudice pursuant to a settlement agreement on October 23, 2023. The details of the settlement agreement are unknown to the Clearinghouse at this time.  The dismissal was granted on the same day.
