This is a class action lawsuit filed on February 2, 2025, in the United States District Court for the Central District of California by the California Coalition for Women Prisoners and several Jane Does currently or formerly incarcerated in the California Institute for Women (CIW). The Plaintiffs sued several employees and officials that worked at CIW between the years of 2016 and 2024, most notably a male gynecologist. This also included the Chief Executive Officer for California Correctional Health Care Services, Chief Medical Executive, Associate Director of Female Offender Programs and Services for the Division of Adult Institutions, Warden and Chief Executive Officers from 2017-2023, Associate Warden, Prison Rape Elimination Act (PREA) Compliance Manager, Medical Assistant, Undersecretary of Health Care, Secretary of California Department of Corrections and Rehabilitation, and 20 John Does. A receiver who was appointed in 2008 to oversee medical services in California state prisons was also named as a defendant.

Plaintiffs alleged that the gynecologist sexually abused them and other women prisoners throughout his time working for CIW, and that the other defendants knew and did nothing to stop him. They brought this action under the Eighth Amendment, the Equal Protection Clause, the Fourth Amendment, and California state and tort law. The plaintiffs were represented by Justice First and private counsel.

The plaintiffs sought to certify multiple classes. There were two damages classes. The first is the received treatment class with examination or procedure subclass and nonconsensual examination or procedure subclass. The received treatment class included any person incarcerated at CIW who was seen by the defendant for obstetric or gynecological medical care between 2016 and May 2024.

The examination or procedure subclass included any person incarcerated at the CIW who was seen by Dr. the defendant for gynecological or obstetric care, and whose visit involved a pelvic exam, rectovaginal exam (or rectal exam), or breast/chest exam and/or any gynecological or obstetric procedure involving the pelvic, rectal or breast areas between 2016 and May 2024. 

The nonconsensual examination or procedure subclass was composed of any person incarcerated at CIW who was seen by the defendant and received any gynecological or obstetric exam or procedure for which the defendant failed to obtain informed consent. The second damages class is the deterred class which was composed of any person incarcerated at the CIW between 2016 and May 2024, who was scheduled by the CIW to see the defendant for gynecological or obstetric care, and who declined to see him and/or declined treatment he recommended.

The plaintiffs also requested an injunctive relief class composed of women currently incarcerated at CIW who may be subject to the conduct of sexual assault and harassment alleged in the complaint. The plaintiffs also sought a declaratory judgement and injunctive relief requiring training, review of procedures, and chaperones during gynecologist visits for women at CIW. The plaintiffs requested damages and attorneys’ fees as well.

On February 3, 2025, the case was assigned to Magistrate Judge Sheri Pym. As of February 25, 2025, this case is ongoing.
