Two undergraduate students of Jewish heritage at the University of Pennsylvania filed suit in U.S. District Court for the Eastern District of Pennsylvania on December 5, 2023. The suit alleged that they, and other students similarly situated, were victim to antisemitic harassment, and that the University had failed to remedy or had even tacitly helped maintain a hostile environment of antisemitism. In describing the atmosphere of hostility that the University helped perpetuate, plaintiffs specifically alleged that the University had hosted the “Palestine writes Literature” Festival and invited antisemitic speakers to the event; and failed to condemn or otherwise enforce the disciplinary measures laid out in its code of conduct against students and faculty members who made pro-Hamas statements after the October 7, 2023 Hamas attack on Israel. Plaintiffs set forth in their complaint that the University is (1) in violation of Title VI of the Civil Rights Act of 1964, 42 U.S.C. §2000d, which prohibits discrimination on the basis of race, color, or national origin in any program which receives federal funding; (2) breached their contract with members of the student body by fostering an antisemitic environment; and (3) violated Pennsylvania Unfair Trade Practices and Consumer Protection Laws, for not acting in accord with statements against discrimination it had made with the “sale” of its educational goods and services.

Plaintiffs sought (1) injunctive relief, to require the University to implement disciplinary measures for students and University staff who engage in antisemitic conduct and implement, and require institutional policies declining donations conditioned on the inclusion of antisemitic coursework, professor scholarship, or hiring; and (2) monetary damages. 

The case was assigned to District Judge Kai N. Scott, later reassigned to District Judge John R. Padova, and later reassigned to Chief Judge Mitchell S. Goldberg. 

On February 12, 2024, Defendant filed a motion with the court to dismiss plaintiffs’ claims with prejudice or, in the alternative, strike in part plaintiffs’ request for relief. Noting several efforts that the University had taken to address antisemitism and statements made condemning antisemitism, defendant made its motion to dismiss on several grounds: (1) that plaintiffs lacked standing to sue for injunctive relief; (2) that the issues alleged in the complaint were insufficiently ripe for legal action, as many of the actions taken by the University were still ongoing and as such, the factual record was still incomplete; and (3) that plaintiff’s complaint failed to plead cognizable claims, under any of the federal or state laws that plaintiff brought their claims under. In the alternative, defendants alleged that any demands for relief that plaintiff made which were not cognizable as a matter of law, such as plaintiff’s plea for an injunction to discipline and terminate staff and students, be stricken.

On February 26, 2024, following defendants’ motion to dismiss, plaintiffs filed notice to amend their complaint. On March 4, 2024, plaintiffs submitted their amended complaint, wherein they added one named plaintiff, also an undergraduate student, and Students Against Antisemitism, a non-profit organization which includes current and former Jewish and/or Israeli students at the University, and realleged their claims with more particularity. Since plaintiffs had amended their complaint, the court denied defendant’s motion to dismiss as moot. 

Defendants re-filed their motion to dismiss with prejudice and their motion to strike, arguing that the amended complaint failed to address the juridical weaknesses outlined in the original motion to dismiss. As defendant’s motion to dismiss was pending a decision, defendant moved for a stay of discovery until the court decided how to resolve the motion, noting that a stay would be especially appropriate here where defendant is seeking complete dismissal of all of plaintiffs’ claims. On January 3, 2025, the court granted defendant’s motion to stay discovery as a ruling on the motion to dismiss was pending.

In the interim, defendant provided supplemental information to the court that it was in the process of creating an Office of Religious and Ethnic Inclusion under Title VI of the Civil Rights Act of 1964, which formally opened on December 17, 2024.

A decision on defendant’s motion to dismiss has not yet been made, and the matter is still active and pending further updates as of February 27, 2025.
