The U.S. Attorney's Office in the Southern District of New indicted New York City Mayor Eric Adams for alleged corruption in September 2024, but after President Trump took office, his Department of Justice directed that charges be dropped.  Acting Deputy Attorney General Emil Bove said the prosecution “unduly restricted” the mayor’s ability to “devote full attention and resources to the illegal immigration and violent crime that has escalated under the policies of the prior Administration.” 

Several DOJ leaders resigned rather than accept this instruction; the interim US attorney for the Southern District, Danielle Sassoon (a Republican), resigned, stating that the proposed dismissal was an illegitimate exchange for Adams' help with Trump’s immigration policy. According to press reports, seven other DOJ officials also resigned, some immediately and others within the next several days. 

Bove's responsive letter to Sassoon accused her of “disobeying direct orders implementing the policy of a duly elected President” and “pursuing a politically motivated prosecution despite an express instruction to dismiss the case. You lost sight of the oath that you took when you started at the Department of Justice.”  

On Feb. 14, 2025, Bove and two other prosecutors signed the request to the court to drop charges (without prejudice to their being refiled in the future).  This request is under consideration by the court; the case is before Judge Dale Ho. Some former prosecutors and the organization Common Cause have sought to be heard on the appropriate next steps, opposing dismissal. A hearing is scheduled for Feb. 19, 2025; Judge Ho has asked the parties to "be prepared to address, inter alia, the reasons for the Government’s motion, the scope and effect of Mayor Adams’s “consent[] in writing,” and the procedure for resolution of the motion." 

On Feb. 21, 2025, the court cancelled the scheduled trial, and--because the government and the defendant were in agreement about dismissing charges--appointed Paul Clement as amicus curiae to present additional arguments on the Government's Motion to Dismiss. Clement had served as U.S. Solicitor General in the George W. Bush Administration.  His brief, filed March 7, took the position that the case should be dismissed--but with prejudice (that is, closing off the possibility of it being refiled) to avoid giving the federal government ongoing leverage over Mayor Adams' activities.  He wrote: "“A dismissal without prejudice creates a palpable sense that the prosecution outlined in the indictment and approved by a grand jury could be renewed, a prospect that hangs like the proverbial sword of Damocles over the accused." 

In the meanwhile, the defendant filed a motion asking the court for exactly the outcome Clement subsequently recommended--to dismiss his indictment with prejudice.  

On April 2, 2025, the court issued its final opinion and order dismissing the case. The court dismissed the case with prejudice, finding that "dismissing the case without prejudice would create the perception that the Mayor's freedom depends on his ability to carry out the immigration enforcement priorities of the administration, and that he might be more beholden to the demands of the federal government than to the wishes of his own constituents." Further, the court found that any "appearances of impropriety" in the case were pretextual and unmerited, waving away any concerns that any party had improper motives in dismissing the case. This result thus prevents any future suit alleging the same facts from being brought against the Mayor. 

This case is now closed.

ORDER as to Eric Adams: On October 3, 2024, the Government requested an ex parte classified conference with the Court pursuant to Section 2 of the Classified Information Procedures Act, 18 U.S.C. app. 3 § 2 ("CIPA"). MEMORANDUM OPINION AND ORDER as to Eric Adams. Before this Court is Defendant Eric Adams's ("Defendant" or "Mayor Adams") letter motion for reconsideration of the trial date in this matter. Def.'s Letter Mot. for Recons. ("Def.'s Mot."), ECF No. 55. Specifically, Mayor Adams requests that his trial, which is currently set for April 21, 2025, be rescheduled to begin by April 1, 2025. Id. at 1. In its response, the Government notes that the parties have been unable to agree on the feasibility of an April 1, 2025, trial date due to, inter alia, their diverging understandings of what discovery must be disclosed by the December 4, 2024, deadline set by this Court. Govt's Resp. to Def.'s Letter Mot. for Recons. ("Govt's Resp."), ECF No. 59. The Government therefore moves for this Court: (1) to clarify what materials are required to be disclosed by the December 4th discovery deadline, (2) to adjourn the Government's response to Mayor Adams's motion for reconsideration, and (3) to order the parties to meet and confer about the feasibility of a pretrial schedule for an April 1, 2025, trial date. For the avoidance of doubt, the Court clarifies that its Scheduling Order prescribing that "[d]iscovery shall be produced by December 4, 2024," ECF No. 33, refers to the production of materials pursuant to Rule 16.(See Footnote 1 on this Memorandum Opinion And Order). In other words, the Government need not provide Mayor Adams with all exculpatory evidence required to be disclosed under Giglio v. United States, 405 U.S. 150 (1972), by December 4, 2024. Under well-established Second Circuit caselaw, Giglio materials need not be disclosed immediately upon request by a defendant. See United States v. Coppa, 267 F.3d 132, 146 (2d Cir. 2001). Instead, such exculpatory material must be disclosed "in time for its effective use at trial or at a plea proceeding." Id. While it is the Government's duty to disclose Giglio evidence in a timely manner to permit its "effective use," id., courts may intervene to direct the Government to disclose Giglio evidence by a certain date "as a matter of sound case management," United States v. Giffen, 379 F. Supp. 2d 337, 347-48 (S.D.N.Y. 2004)....[*** See this Memorandum Opinion And Order ***]... In light of the foregoing, the Court RESERVES JUDGMENT on Mayor Adams's motion for reconsideration and GRANTS the Government's motion. The Government's deadline for responding to Mayor Adams's motion for reconsideration is accordingly ADJOURNED to November 27, 2024. The parties are ORDERED to meet and confer with respect to: (a) the feasibility of a pretrial schedule for an April 1, 2025, trial date, including but not limited to deadlines for expert disclosures, the production of Giglio and Jenks Act materials, and motions in limine; and (b) the form of any necessary and permissible waivers needed for an April 1, 2025, start of trial. The parties are ORDERED to submit a joint status letter no later than November 27, 2024, via ECF describing whether they have reached an agreement on the matters discussed above and a proposed pretrial schedule; if the parties are unable to reach agreement, the letter shall set forth their respective positions and proposed pretrial schedules with respect to these matters. ORDER as to Eric Adams. On December 17, 2024, Defendant New York City Mayor Eric Adams ("Adams" or "Mayor Adams") filed a letter motion requesting an adjournment of the case management conference in this matter scheduled on December 20, 2024, and that the conference be scheduled after January 20, 2025. See Def. Letter Motion, Dec. 17, 2024, ECF No. 70. The letter also indicated that Mayor Adams "intends to seek leave to file a motion for a bill of particulars this week." Id. The Government filed a letter on December 18, 2024, indicating that it intends to raise "an issue relating to extrajudicial statements that defense counsel has made relating to the case" at the upcoming conference. Gov't Status Letter, Dec. 18, 2024, ECF No. 71. The December 20 case management conference was originally scheduled for December 13, 2024, for the purpose of updating the Court as to the status of discovery and setting a pretrial schedule in this matter. The Court adjourned the conference to December 20 at the request of defense counsel, who did not, at that time, indicate any conflicting commitments. See Conf. Tr. 63-65, ECF No. 57. In the letter motion, however, counsel for Mayor Adams represents that he "is currently out of state and actively engaged on other matters." ECF No. 70.1 In any event, the issues that the parties have identified in their letters can be addressed via motions or letters to the Court (and Mayor Adams has already filed his motion for a bill of particulars, see ECF No. 72). Accordingly, Defendant's motion is GRANTED. The case management conference is hereby adjourned to sine die. A pretrial schedule in this matter will issue separately. The Court also notes that it previously scheduled CIPA Section 4 hearings, if necessary, for the week of January 27, 2025. See Order, ECF No. 62. The parties are hereby ORDERED, by December 20, 2024, to each submit status letters indicating their availability for in-person proceedings during that week. (Signed by Judge Dale E. Nonetheless, defense counsel has continued to violate the Rule, including as recently as December 17, 2024. Accordingly, the Government respectfully submits this letter to request that the Court direct counsel for the parties to comply with the Rule....
