This case challenged the Trump Administration’s efforts to dismantle the U.S. Agency for International Development (USAID) and halt foreign aid funding. On January 20, 2025, President Trump issued Executive Order 14169, pausing all U.S. foreign development assistance for 90 days. Four days later, on January 24, the Secretary of State officially implemented the Executive Order, suspending all USAID programs and issuing “stop-work orders” for contracting officers. These actions occurred within the broader context of the Administration’s efforts to dismantle several federal agencies and shrink others.

As a response to the Executive Orders, on February 18, 2025, the U.S. Personal Services Contractor Association filed this lawsuit in the U.S. District Court for the District of Columbia. The plaintiff, a voluntary association representing U.S. citizen personal services contractors (USPSCs) employed by USAID, sued Donald Trump; the United States Department of State; the United States Agency for International Development; and the Office of Management and Budget. Represented by private counsel, the USPSC Association sought declaratory and injunctive relief. The Association alleged that these orders are “irreparably injuring” USPSCs by preventing them from carrying out their work, endangering their safety overseas, disrupting essential medical services, and risking stable housing. They claimed that the government’s actions violated the separation of powers, the Take Care Clause of the Constitution, the Administrative Procedure Act, the Impoundment Control Act, and the Anti-Deficiency Act. This case was assigned to Judge Carl J. Nichols. 

In other cases arising from this same Executive Order, other judges had issued temporary restraining orders to protect USAID direct-hire employees and to disburse foreign-assistance funds. At the time, however, there was no court order expressly protecting USPSCs. The Association filed a motion for a temporary restraining order (TRO) on February 19, 2025. After a hearing, on March 6, the Court orally denied the plaintiff’s motion for a TRO. On March 11, 2025, the Association filed an emergency motion for a TRO to preserve evidence, claiming that there were concerns that USAID was spoliating evidence. The Court denied this motion for a TRO as well on March 14, 2025. Citing the government’s credible attestation that “USAID is not destroying documents potentially germane to this case,” the Court reasoned that the Association had not demonstrated that it would suffer irreparable harm absent a TRO. 

On April 17, 2025, the plaintiffs filed an amended complaint. The amended complaint significantly expanded the scope of the lawsuit by adding defendants involved in the alleged dismantling and impoundment of funds -- U.S. DOGE Service and the U.S. Department of the Treasury. It also provided extensive new factual details about the actions taken, especially concerning DOGE's role and the specific steps and dates related to the termination of employees and programs. The plaintiffs added a distinct cause of action alleging "ultra vires" activity by all defendants and included more detailed and specific requests for injunctive relief directly tied to the newly alleged facts and the claimed "finality" of USAID's dismantling. 

A few days later, on April 23, the plaintiffs filed a motion for a preliminary injunction. The Association contended that the defendants lack constitutional or statutory authority to abolish the Congressionally-created agency and impound billions in appropriated funds, which would violate the separation of powers and the Impoundment Control Act, among other laws. They argued that allowing the mass termination of the specialized USAID workforce, the destruction of its infrastructure, and the cessation of its programs will cause irreparable harm, including catastrophic human costs globally, which cannot be remedied later, and that the balance of equities and public interest strongly favor granting the injunction to preserve the agency and its critical functions. 

On June 6, the plaintiffs filed a memorandum addressing several recent decisions in the D.C. Circuit addressing the alleged dismantling of the United States Agency for Global Media (USAGM). In those cases, District Judge Lamberth entered preliminary injunctions to keep USAGM operating during the litigation. On appeal, the D.C. Circuit stayed the portions of the injunctions requiring the government to restore employees and grants to pre-litigation status. However, sitting en banc, the appeals court lifted the stay regarding the grants while leaving in place the stay regarding rehiring.

In this case, the plaintiffs argued that these other decisions provided support for their argument that the court had subject-matter jurisdiction in this case, since, by leaving in place the district court's injunction regarding the grants, the appeals court concluded that there was likely jurisdiction over the case. The plaintiffs argued that the same result should follow here.

On the other hand, in a June 6 supplemental brief, the defendants argued that, by leaving in place the stay on rehiring USAGM employees and contractors, the en banc decision supported their argument that the court lacked jurisdiction over the employee firings in this case because it is precluded by the administrative procedures put in place by Congress. The defendants also attempted to differentiate the grants at issue in this case from those at issue in the other cases because the grants at issue here "do not generally require the provision of specific funds to specific recipients," meaning that there is no specific statutory mandate that the court could order USAID to fulfill, unlike the grants in the other cases.  

On July 25, the court denied a preliminary injunction. The court held that it likely lacks jurisdiction over the claims of the PSCA. The court found that "PSCA likely does not have standing to challenge the government’s non-personnel actions with respect to USAID, such as its grant terminations, website closures, and lease transfers where the associations have alleged no concrete and particularized injuries flowing from those actions specifically." Instead, the court ruled that the PSCA has "standing only to object to the government’s personnel related actions at USAID, which is the only challenged conduct that has caused them particularized injury." However, with regard to those claims, the court found that the "Contract Disputes Act (CDA) likely channels its members’ claims to either the Board of Contract Appeals or the Court of Federal Claims." Therefore, the court said that it did not have jurisdiction over PSCA's claims, and thus it found that PSCA was unlikely to succeed on the merits of its challenges. Given those rulings, the court denied a preliminary injunction. 

This case is ongoing.

MINUTE ORDER. On May 3, 2025, a motions panel of the Court of Appeals issued an order in Case No. 25-5144, Widakuswara et al. v. Lake, which stayed in part several preliminary injunctions issued by the district court in litigation regarding the United States Agency for Global Media (USAGM). Among other things, the motions panel held that "the district court likely lacked subject-matter jurisdiction to enjoin USAGM's personnel actions." On May 22 and 28, 2025, the en banc Court of Appeals issued orders concerning the petition for en banc rehearing of the motions panel's order. It is therefore ORDERED that, on or before June 6, 2025, the parties shall file supplemental briefs, not to exceed 15 pages, regarding the import of those developments on this case. The parties' briefs should specifically address whether and to what extent the motions panel's decision is binding on the Court in light of its procedural posture and the pertinent factual differences, if any, between the claims in this case and those involving USAGM.
