This case challenged the Trump Administration's February 2025 attempt to rescind federal funding for the State of New York's congestion pricing program in New York City, despite the federal government's previous agreement that New York State could assess tolls on vehicles entering federal highways around the city. New York State had already fully implemented the congestion pricing program beginning on January 5, 2025.

On February 19, 2025, plaintiffs Metropolitan Transportation Authority (MTA) and Triborough Bridge and Tunnel Authority (TBTA) filed this lawsuit in the U.S. District Court for the Southern District of New York against the U.S. Department of Transportation (DOT) and the Federal Highway Administration. Plaintiffs alleged that defendants' actions exceeded presidential authority and violated the Due Process Clause, the National Environmental Policy Act, and the Administrative Procedure Act. They sought declaratory and injunctive relief and attorneys’ fees. The case was assigned to Judge Lewis Jeffrey Liman and Magistrate Judge Barbara C. Moses.

On March 4, 2025, the Riders Alliance and the Sierra Club filed a motion to intervene as plaintiffs (granted March 19). On March 19, 2025, the New York State Department of Transportation (NYSDOT) filed a motion to intervene as plaintiff (granted March 26). All three intervenors then filed intervenor complaints on March 27, 2025. On April 2, 2025, the New York City Department of Transportation (NYCDOT) filed a motion to intervene as plaintiff (granted April 9). On April 18, 2025, plaintiffs filed their first amended complaint, incorporating the intervenor complaints of NYSDOT, the Riders Alliance, the Sierra Club, and the NYCDOT.

On April 23, 2025, the federal government accidentally filed a letter that a DOJ attorney sent to a DOT attorney, expressing skepticism about the validity of the legal theory the United States was pursuing in the case. The letter was quickly replaced, but is available on the Clearinghouse. The next day, after an exchange of letters, the court granted the defendants' motion to seal the docket item filed in error. The court asked two questions: whether the wide dissemination of the letter via media outlets meant that sealing the docket was without sufficient basis, and whether the publication of the letter waived privilege. On May 14, 2025, after briefing by the parties, the court elected to unseal the letter but prohibit plaintiffs from using its contents in the case.

On May 27, 2025, the court issued a temporary restraining order prohibiting defendants from acting on the purported termination of the government’s agreement with New York State and forbidding attempts by defendants to procure New York’s compliance with the termination, including withdrawal of funding or authorizations from the state or any of its agencies. Just one day later, on May 28, 2025, the court issued a preliminary injunction to the same effect, finding that the benefits offered by congestion pricing outweighed the harm claimed by defendants in being temporarily unable to implement their preferred policy.

On June 6, 2025, the court approved a briefing schedule jointly proposed by all parties. Cross-motions for summary judgment from both plaintiffs and defendants are due June 27, 2025. Replies to each cross-motion from the adverse party are due July 18, 2025. This case is ongoing.
