This case is about the White House’s barring of the Associated Press (AP) from certain press access areas due to the AP’s refusal to refer to the Gulf of Mexico as the Gulf of America. On January 20, 2025, President Donald Trump issued Executive Order 14172 renaming the Gulf of Mexico as the Gulf of America. On February 21, 2025 the Associated Press, represented by private counsel, brought this suit against the White House Deputy Chief of Staff, the Chief of Staff, and the White House Press Secretary in the United States District Court for the District of Columbia. This case was assigned to Judge Trevor N. McFadden.

On February 11, 2025, the White House began barring the AP from entering certain areas in the White House as a member of the press pool, because of the AP’s decision to “refer to the Gulf of Mexico “by its original name while acknowledging the new name Trump has chosen.” On February 14, the White House barred the AP indefinitely from the “press pool, Oval Office, Air Force One, and other limited areas.” The AP claims that “Defendants’ actions are impermissibly based on their dislike of the content of the AP’s expression and what they perceive as the AP’s viewpoint reflected in the content of its expression.”

The AP challenged the White House’s actions under the Fifth Amendment and the First Amendment. Under the Fifth Amendment, the AP argued that the White House, because it had made the spaces in question available to other members of the press pool, could not deny the AP’s access without due process of law. Under the First Amendment, the AP alleged that the White House infringed upon free speech by compelling speech and engaging in content- and viewpoint-based discrimination. They demanded a jury trial, and asked the court to rescind their denial of access, as well as for declaratory relief.

On February 21, 2025 the AP submitted motions for a Temporary Restraining Order (TRO) and for a Preliminary Injunction (PI). The court denied the request for a TRO on February 24, 2025. 2025 WL 593438. The AP filed an amended complaint on March 3, 2025. The amended complaint detailed the AP’s continued exclusion from press events following the filing of this lawsuit. The court warned the White House to reconsider its actions in light of case law, but the White House instead announced it would begin hand picking outlets to cover the president, a role usually held by the White House Correspondents Association. A PI hearing was held on April 1, 2025. On April 8, the Court ruled in favor of the AP, granting the PI. The Court emphasized that while the Government has the discretion to decide which journalists are admitted to specific events, it cannot exclude journalists purely based on their viewpoints. 780 F.Supp.3d 32. The court then, on its own motion, ordered a stay on its order to "provide the Government time to seek an emergency stay from a higher court and to prepare to implement the Court’s injunction."

On April 9, the defendants filed a notice of interlocutory appeal. The following day, defendants filed an emergency motion with the district court to stay its order pending appeal, which was denied on April 11. 2025 WL 1095385.

On April 16, plaintiffs filed a motion in the district court to enforce the PI, alleging that the Trump administration had not adhered to it. Following a hearing held on April 18, the court denied the motion. On April 25, defendants filed a consent motion to stay further proceedings in the district court, which was granted on April 28. 

In the Court of Appeals, defendants filed an emergency motion on April 10, 2025, to stay the lower court's order. On June 6, the court granted the motion in part, staying the PI except insofar as it applied to the East Room. 2025 WL 1649265. Judge Rao wrote for the panel majority that the Oval Office, Air Force One, and similar spaces were not public, and that the president could discriminate on the basis of viewpoint in admission to those spaces; thus the defendants had a high likelihood of success on the merits, and a stay was warranted. On June 10, plaintiffs filed an emergency petition for rehearing en banc of the stay. 

On July 22, the Court of Appeals denied Plaintiffs' motion for en banc reconsideration. 2025 WL 2047025. They found that the standard for en banc review was not met because the stay was a non-precedential order that did not purport to resolve the appeal's merits. 

Oral argument before the Court of Appeals is scheduled for November 24, 2025. The case is ongoing.
