This case challenged a Brazilian judge’s authority to suspend social media accounts held in the United States. On February 19, 2025, Rumble Inc. and Trump Media and Technology Corp., two private corporations, filed this lawsuit in the U.S. District Court for the Middle District of Florida. The plaintiffs sued Alexandre de Moraes, the President of the Superior Electoral Court, Brazil’s highest court, under the Declaratory Judgment Act. Represented by private counsel, the plaintiffs alleged that Judge Moraes had issued a sweeping "gag order" suspending multiple social media accounts based in the U.S., such that no one in the United States could see the suspended content, thereby "censor[ing] legitimate political discourse in the United States." The complaint specifically alleged that the judge had suspended nearly 150 accounts since 2022, which "target[ed] critics of current Brazilian President Luiz Inacio ‘Lula’ da Silva, including conservative legislators, journalists, jurists, and even musical performers. The plaintiffs alleged that the judge's "gag orders" violated the First Amendment, the Communications Decency Act, Florida's Statutory Foreign Judgment Nonrecognition Policy, and foundational principles of comity between nations. The plaintiffs sought a judgment declaring Judge Moraes’s orders unenforceable in the United States. The plaintiffs asked the court to vacate the terminations and also sought a preliminary and permanent injunction, declaratory relief, and attorney’s fees. The case was assigned to District Judge Mary Scriven.  

On February 25, 2025, the court declined to grant a temporary restraining order, without prejudice.  Judge Scriven explained that the "pronouncements and directives purportedly issued" by the defendant were not properly served on the plaintiffs or otherwise rendered effective.  For that reason, the plaintiffs were not obligated to comply with those directives.  In addition, she wrote, there had been no other enforcement action taken. In sum, the issue was not ripe--so there was no need for emergency relief. 2025 WL 607113. 

On March 4, a non-party, Marcel Honda, filed a pleading styled as a motion to intervene, which the plaintiff moved to strike. The court struck the intervenor's complaint on April 29, though on May 28, the proposed intervenor moved for reconsideration.

The plaintiffs filed an amended complaint on June 6. The amended complaint contained additional factual allegations regarding Rumble and Truth Social's services, added examples of Justice Moraes' targeting of U.S. citizens/residents, and mentioned U.S. Government actions recognizing Justice Moraes' deeds as unlawful. The amended complaint alleged an additional cause of action under the Stored Communications Act and brought claims for tortious interference with contractual and prospective business relations. The plaintiffs also requested monetary damages in their prayer for relief. 

This case is ongoing.
