This case challenged the Federal Emergency Management Agency’s (FEMA) repeated blocking of grant reimbursements under the Congressionally-funded Next Generation Warning System (NGWS), a program to modernize the nation’s emergency alert infrastructure. On March 13, 2025, the Corporation for Public Broadcasting (CPB) filed this lawsuit in the U.S. District Court for the District of Columbia against FEMA and its acting administrator Cameron Hamilton. 

The case was assigned to Judge Timothy J. Kelly.

CPB, represented by Saul Ewing LLP, alleged that FEMA unlawfully froze access to funds already awarded and obligated under the NGWS grant, in violation of the Administrative Procedure Act (APA), the Uniform Guidance (2 C.F.R. Part 200), and federal court orders barring the implementation of a White House directive (OMB Memorandum M-25-13) suspending federal awards. CPB administers the NGWS program on behalf of Congress and subawards funding to public broadcasters across the country to upgrade emergency communications infrastructure. CPB asserted that FEMA’s actions left over $2.7 million in already-incurred expenses unreimbursed, paralyzed additional upgrades, and endangered critical public alerting capacity in rural and disaster-prone regions.

According to the complaint and subsequent declarations, FEMA repeatedly toggled access to its Payment and Reporting System (PARS), used for grant reimbursements, without notice or explanation. CPB alleged that FEMA’s actions defied federal regulations governing grant management, violated due process requirements, and caused irreparable harm to both CPB and its 42 subgrantee broadcasters. CPB also contended that FEMA ignored binding court orders—including injunctions from other federal courts—prohibiting implementation of the funding freeze.

On the day it filed this lawsuit, CPB moved for a temporary restraining order (TRO) to restore access to the PARS system and enjoin FEMA from interfering with the grant. The court denied the TRO after a March 17 hearing, finding that CPB had not yet demonstrated irreparable harm. FEMA then reinstated partial access to PARS but continued to subject CPB to what it described as a “manual review process,” which CPB claimed was unlawful, burdensome, and pretextual.

On June 12, CPB moved for a preliminary injunction (PI). CPB presented evidence that FEMA’s conduct violated multiple federal statutes, including 2 C.F.R. §§ 200.305 and 200.341, and ignored prior injunctions issued in Nat’l Council of Nonprofits v. OMB (D.D.C.) and New York v. Trump (D.R.I.). CPB also argued that FEMA had improperly injected questions about “support to aliens” into the reimbursement process, despite the NGWS grant having no connection to immigration-related activity.

CPB’s brief documented widespread operational harm, citing delays in public alerting upgrades, disruptions to emergency communications in underserved areas, loss of trust from partner stations, and the erosion of CPB’s reputation. CPB requested a preliminary injunction directing FEMA to maintain access to PARS, timely process reimbursement requests, and provide 30 days’ notice before suspending access in the future.

This case is ongoing.
