This case challenges high-level federal officials' use of encrypted, auto-deleting messaging apps to conduct national security business, raising serious record-keeping and transparency concerns. On March 25, 2025, American Oversight filed this lawsuit in the U.S. District Court for the District of Columbia against the Secretary of Defense, the Director of National Intelligence, the Director of the CIA, the Secretary of Treasury, the Secretary of State, and the National Archives and Records Administration. The plaintiffs challenged the defendants’ use of the messaging application Signal, which can be set up to automatically delete messages, to discuss planned and ongoing military operations in Yemen from March 11 to March 15, 2025. The plaintiffs sued under the Federal Records Act, the Administrative Procedure Act, and the Declaratory Judgment Act. The case was assigned to Chief Judge James E. Boasberg. 

The group chat that prompted the lawsuit included Secretary of Defense Pete Hegseth, Director of National Intelligence Tulsi Gabbard, CIA Director John Ratcliffe, Treasury Secretary Scott Bessent, Secretary of State and Acting Archivist Marco Rubio, and other senior White House figures. Journalist Jeffrey Goldberg of The Atlantic was inadvertently added to the Signal chat and later published an exposé documenting the discussions, which allegedly included sensitive or even classified information.

The plaintiffs alleged that this use of Signal violated the Federal Records Act, which requires federal agencies to preserve records documenting government functions and decisions. The plaintiffs argued that these messages qualified as federal records and should have been archived rather than deleted. Because Signal messages auto-delete and are not backed up on government servers, the plaintiffs contended that messages were unlawfully removed or destroyed. Moreover, the agency heads failed to notify the Archivist or initiate action through the Attorney General as required by law. Rubio, who also serves as the Acting Archivist of the United States, was separately alleged to have failed in his independent statutory duty to initiate enforcement action after the other agencies did not.

The complaint also referenced multiple FOIA requests that American Oversight had submitted to the Departments of Defense, State, and Treasury. These requests, many of which explicitly asked for Signal messages, remain pending. American Oversight argued that the agencies’ failure to preserve these records undermined its ability to access government information and obstructed its transparency mission.

Represented by private counsel, the plaintiffs sought emergency and permanent injunctions requiring the defendants to preserve and recover the Signal messages, to comply with their statutory records duties, and to refer the matter to the Attorney General. The plaintiffs also sought attorneys’ fees and litigation costs.

On March 26, the plaintiffs filed a motion for a temporary restraining order seeking immediate preservation of the Signal messages. On March 27, the court held a hearing on the TRO, and issued a minute order, not styled as a TRO, requiring defendants to preserve the Signal messages and file a status report. 

On April 21, 2025, the plaintiffs filed an amended complaint that added Rubio as a defendant, emphasizing his statutory obligations under the Federal Records Act to initiate recovery and enforcement measures when federal records are at risk of destruction. The amended complaint also narrowed and specified the factual allegations. While the original complaint generally referenced the defendants’ use of Signal, the amended version focused on communications exchanged between March 11 and March 15, 2025, relating to national security decisions, including potential military action in response to foreign threats. The amended complaint refined its claims by identifying specific statutory provisions under the Federal Records Act that defendants allegedly violated, and it explicitly connected each defendant to their role in either using or failing to preserve federal records. It also incorporated a formal request for preliminary injunctive relief, asking the court to order the preservation and recovery of any Signal messages sent or received during the relevant time period. The amended complaint emphasized the urgency of preventing further deletion, arguing that continued loss of these records would result in irreparable harm to the public’s ability to evaluate high-level government decision-making. The plaintiffs refiled their motion for a preliminary injunction on April 22 after the court struck the initial motion for violating local rules on excessive footnotes. 

On May 16, the court held a hearing on the motion for a preliminary injunction. 

On June 20, Judge Boasberg granted in part and denied in part the plaintiffs’ motion for a preliminary injunction. 2025 WL 1721995. The court held that plaintiffs were likely to succeed on the merits of their claim that federal officials had violated the Federal Records Act by failing to preserve Signal messages related to official business. The order directed the defendant agency heads to notify the Archivist of the United States if they or their subordinates had engaged in Signal communications during March 11–15, 2025, that likely qualified as federal records and were at risk of deletion. The court further ordered Rubio, in his capacity as Acting Archivist, to request that the Attorney General initiate action to recover those records and to notify Congress of the potential violations, pursuant to 44 U.S.C. § 3106. The defendants were also directed to submit a status report by June 27, 2025, detailing their compliance with the order.

On July 3, 2025, the defendants filed a motion to dismiss the case. 

The case is ongoing.
