On April 1, 2025, the Middle East Broadcasting Networks filed this lawsuit in the United States District Court for the District of Columbia against the United States of America, the U.S. Agency for Global Media, the Office of Management and Budget, the U.S. Department of Treasury, and their corresponding agency heads. The case was assigned to Judge Royce C. Lamberth. The Plaintiff challenged Defendant’s refusal to disburse funds appropriated to it by Congress. The Plaintiff alleged that Defendant’s actions violated the Administrative Procedure Act, the Presentment Clause, the Appropriations Clause, the Spending Clause, the Take Care Clause, and the Separation of Powers. The Plaintiffs sought declaratory and injunctive relief as well as attorney fees. The Plaintiff were represented by Democracy Forward and Munger, Tolles & Olson LLP. 

On April 9, 2025, the Plaintiff filed a Motion for a Preliminary Injunction. On April 25, 2025, the motion was granted, and Judge Lamberth ordered defendants to "restore" FY2025 grants to plaintiff. The defendants filed a motion for a stay pending appeal with the D.C. Circuit on April 25, and on May 1, the panel Judges Pillard, Katsas and Rao, granted defendants' motion over Judge Pillard's dissent. But plaintiffs sought an emergency rehearing en banc which the D.C. Circuit granted, vacating the panel's stay. As of May 7, then, preliminary injunction is back in effect.
