This case challenged termination of an international student's status. The case was filed on April 7, 2025, in the United States District Court for the Northern District of California. 

The pseudonymous plaintiff, John Doe, was represented by attorneys from Van Der Hout LLP. The defendants were President Donald J. Trump, Moises Becerra, in his official capacity as Acting Field Office Director of the San Francisco Office of Detention and Removal, U.S. Immigrations and Customs Enforcement; and the U.S. Department of Homeland Security.  

The plaintiff brought claims under the Administrative Procedure Act and the Declaratory Judgment Act. The complaint detailed that the plaintiff was an F-1 status student with Optional Practical Training (OPT) employment authorization. The plaintiff's SEVIS record was terminated by the U.S. Department of Homeland Security (DHS) and U.S. Immigration and Customs Enforcement (ICE) on March 28, 2025, with the reason cited as "Otherwise Failing to Maintain Status" under the Immigration and Nationality Act (INA).  

The plaintiff contended that the termination of their SEVIS record was unlawful and that ICE was not authorized to terminate their student status. The complaint also expressed fear of retaliatory arrest and detention. , and sought a declaration that the termination of their SEVIS record was unlawful, an order to restore their SEVIS record and status, and an injunction to prevent enforcement actions, detention, transfer, or removal.  

On April 16, 2025, the plaintiff filed a motion for a temporary restraining order, asking the court to enjoin defendants from arresting, transferring, or otherwise incarcerating plaintiff pending resolution of these proceedings. He also asked that his SEVIS record be declared without legal force for the duration of this litigation, which was necessary so that he could continue to work.

This case was assigned to Judge Jeffrey S. White, and was set as the lead case for numerous other cases raising the same issues, each of which was marked related to this one.  

On April 25, 2025, the court held a hearing on the TRO filings in all the related cases, and granted or extended TROs in all of them, and set a time for a Preliminary Injunction hearing. The preliminary injunction hearing was held May 14. 

Faced by this and other similar litigation around the country, ICE announced that day that it was restoring SEVIS records for all the petitioners and others similarly situated, while it "develop[ed] a policy that will provide a framework for SEVIS record terminations."  It stated that "[u]ntil such a policy is issued, the SEVIS records for the plaintiffs in these above-captioned cases (and other similarly situated plaintiffs) will remain Active or shall be re-activated if not currently active." 

This case is ongoing.
