PAPERLESS ORDER. THIS MATTER is before the Court sua sponte. On April 2, 2025, Plaintiffs filed an Expedited Motion for a Temporary Restraining Order and Preliminary Injunction (DE 4) ("Motion"). In the Motion, Plaintiffs request the Court grant a temporary restraining order preventing enforcement of Florida law S.B. 4-C pending consideration of Plaintiffs' request for a preliminary injunction. (DE 4 at 1, 20.) A court may not grant a temporary restraining order without notice to the adverse party unless "the movant's attorney certifies in writing any efforts made to give notice and the reasons why it should not be required." Fed. R. Civ. P. 65(b)(1)(B). Further, Southern District of Florida Local Rule 7.1(d)(2) requires that an expedited motion "set forth in detail the date by which an expedited ruling is needed and the reason the ruling is needed by the stated date." Plaintiffs have not filed proof of service of any Defendants, and the Motion does not describe any other efforts made to give notice to Defendants or any reason why notice should not be required. The Motion also fails to set forth a date by which an expedited ruling is needed with accompanying reasoning. Cox's Joint Motion to stay Defendants' deadline to respond to the Complaint and all discovery deadlines (DE 34 ) and Plaintiffs and the State Attorney Defendants' Joint Motion for a Stay of Deadlines to Respond to Complaint and Discovery Deadlines (DE 39 ) (together "Motions to Stay"). In the Motions to Stay, all Parties request a stay of Defendants' joint response deadline and the Parties' discovery deadlines in light of the impact that Plaintiffs' pending Motion for Preliminary Injunction (DE 4 ) ("Motion for PI") will have on the case and the likelihood any order on the Motion for PI will be appealed. See Pinares v. United Techs. Corp., No. 10-80883-CIV, 2019 WL 8129287, at *1 (S.D. Fla. Feb. 12, 2019) (using the "district court['s] broad discretion to stay its own proceedings" pending appeal because the appellate ruling would likely simplify the issues and no party would be unduly prejudiced by the stay).
