This case challenged a Florida law that criminalizes undocumented immigrants’ presence in the state. On April 2, 2025, the Florida Immigrant Coalition (FLIC) and the Farmworker Association of Florida (FWAF), along with two anonymous individual plaintiffs, filed this lawsuit in the U.S. District Court for the Southern District of Florida. The plaintiffs, represented by the ACLU Immigrants’ Rights Project, Americans for Immigrant Justice, and the Community Justice Project, sued the Florida Attorney General, the Statewide Prosecutor, and all twenty elected State Attorneys in their official capacities. The plaintiffs alleged that Senate Bill 4-C (“SB 4-C”)—which created new state crimes for “unauthorized” immigrants entering or remaining in Florida—was unconstitutional. They claimed that the law was preempted by federal immigration law in violation of the Supremacy Clause and violated the Dormant Commerce Clause. Plaintiffs sought declaratory and injunctive relief, class certification. 

The case was assigned to Judge Kathleen M. Williams.

SB 4-C, enacted in 2024 and codified at Florida Statutes §§ 811.102 and 811.103, created two felony offenses: the first criminalized knowingly entering Florida after entering the United States unlawfully; the second criminalized reentering or remaining in Florida after being deported or removed from the country. The law incorporated federal immigration law terms and carved out exceptions where the federal government had granted lawful presence. The plaintiffs argued that despite these references, the law intruded into an area exclusively governed by federal authority.

Alongside their complaint, plaintiffs filed an emergency motion for a temporary restraining order (TRO), a motion for a preliminary injunction (PI), and a motion for class certification. On April 3, the district court initially denied the TRO for failure to comply with local rules, but granted the TRO the next day after supplemental briefing. The court enjoined enforcement of SB 4-C statewide for fourteen days, finding plaintiffs were likely to succeed on their preemption and Commerce Clause claims and faced irreparable harm.

After the TRO went into effect, plaintiffs reported that local law enforcement officers continued to make arrests under SB 4-C. In response, the court clarified that its injunction extended to any Florida law enforcement officer with authority to enforce the statute. The defendants objected that this improperly bound non-parties and violated Federal Rule Civ. Pro. 65. The court rejected those arguments and, on April 29, 2025, granted a PI, again enjoining all enforcement of SB 4-C by any state or local officer. It also provisionally certified two Rule 23(b)(2) classes representing all individuals reasonably at risk of prosecution under either section of the law. The court ordered the Attorney General to show cause why his public statements questioning the order’s scope did not violate the injunction.

On April 30, the defendants filed a notice of appeal to the Eleventh Circuit and moved to stay the injunction pending appeal. The district court declined to rule on the stay request, deferring to the appellate court. On June 6, a motions panel of the Eleventh Circuit denied the stay. The panel concluded that the state had not shown a strong likelihood of success on the merits, finding that SB 4-C was likely subject to "field preemption" by the federal Immigration and Nationality Act. The court declined to stay the injunction even in part, leaving intact the provision binding non-party law enforcement officers.

On June 17, the Florida Attorney General filed an emergency application with Justice Clarence Thomas, seeking a stay of the injunction from the U.S. Supreme Court pending appeal and, if necessary, future proceedings in that Court. The application argued that SB 4-C merely tracked federal law and that the district court exceeded its authority by binding non-parties. It also claimed the injunction imposed irreparable harm on the state’s sovereign interests and exposed officials to contempt for conduct they could not control. On July 9, the Supreme Court justices without comment denied a request to allow the state to enforce SB 4-C.

The case remains ongoing.
