In early 2025, the DOE issued a series of directives (the “Title VI Documents") addressing DEI practices in federally funded schools. On February 14, a “Dear Colleague” letter warned that racially discriminatory practices in DEI programs, including in admissions, hiring, training, or instruction, could violate federal law and directed schools to cease such activities. Although the DOE framed the letter as a restatement of existing obligations under Title VI and the Constitution, the National Association for the Advancement of Colored People (NAACP) characterized it as coercive and overbroad. On February 28, the DOE released a follow-up FAQ expanding on its interpretations and cautioning against practices such as privilege walks, race-based student groupings, and pressuring students to adopt political stances on race-related issues. Finally, on April 3, the DOE imposed a certification requirement mandating that all recipients of federal education funds attest to compliance or risk loss of funding and liability under the False Claims Act.  

On April 15, 2025, the NAACP filed this lawsuit in the U.S. District Court for the District of Columbia against the DOE, its Secretary, and its Assistant Secretary for Civil Rights. The plaintiffs alleged violations of the Equal Protection Clause, the Due Process Clause, the First Amendment, the Administrative Procedure Act, 42 U.S.C. § 1983, and Title VI of the Civil Rights Act of 1964. Represented by private counsel from the NAACP Legal Defense Fund, the NAACP sought declaratory judgment that the directives were unlawful and unconstitutional, as well as a preliminary and permanent injunction to halt their enforcement, an order to set them aside, and an award of costs and fees. Judge Dabney Friedrich was assigned to the case.

The plaintiffs argued that the directives intentionally discriminated against NAACP members in violation of the Equal Protection Clause. They contended that the documents were unconstitutionally vague, violating the Due Process Clause by using undefined terms such as “DEI,” which coerced schools into eliminating a wide range of beneficial programs. The plaintiffs further claimed that the directives infringed upon their First Amendment rights to receive instruction free from viewpoint discrimination, and that they were enacted without proper legal procedure in violation of the Administrative Procedure Act. Finally, the plaintiffs alleged a violation of 42 U.S.C. § 1983 and that the directives misinterpreted Title VI of the Civil Rights Act of 1964, thereby unlawfully denying Black children equal educational opportunities.

On April 24, 2025, Judge Friedrich granted the motion for the preliminary injunction in part. 2025 WL 1196212. The court rejected the First Amendment claim for lack of standing and upheld the DOE’s decision to issue the letters without prior notice and comment. However, the court enjoined the certification requirement because it found it likely violated due process by failing to define what constituted an unlawful DEI practice clearly.

On May 9, 2025, the plaintiffs filed an amended complaint that added the Mid-Atlantic Equity Consortium, Inc. (MAEC), which provides DEI-related services to schools, as a plaintiff. Additionally, the amended complaint expanded on the harms caused by the DOE’s policies, including contract cancellations, reputational damage, and the stifling of educational opportunities for Black students. 

On June 23, 2025, the defendants moved to dismiss the amended complaint, arguing that the plaintiffs lacked standing and that the case was not ripe for judicial review. They asserted that the plaintiffs had not shown a concrete or imminent injury, as no applicant had been denied funding, penalized, or subjected to enforcement action under the challenged certification requirement. The defendants maintained that, because the policy was framed as guidance rather than a final agency action, it was not subject to review under the Administrative Procedure Act. They further argued that, even if the policy were considered a final agency action, it fell within the Department’s interpretive and enforcement authority and did not require notice-and-comment rulemaking.

The defendants also rejected the NAACP’s constitutional claims, asserting that the policy was not unconstitutionally vague and merely reaffirmed existing obligations under Title VI. They emphasized the Department’s broad discretion in administering federal grant programs, contending that the certification requirement was a lawful exercise of that discretion and did not violate the First Amendment or the Due Process Clause.

The case remains ongoing.

MINUTE ORDER. The plaintiff in this case has filed a 13 Motion for Preliminary Injunction. In order to obtain such emergency relief, the movant bears the burden of demonstrating, among other things, a likelihood of success on the merits. League of Women Voters v. Newby, 838 F.3d 1, 6 (D.C. Cir. 2016). That includes "a substantial likelihood of standing under the heightened standard for evaluating a motion for summary judgment." Mennonite Church USA v. DHS, --- F. Supp. 3d ---, No. 25-cv-00403 (DLF), 2025 WL 1094223, at *3 (D.D.C. Apr. 11, 2025). As the plaintiff acknowledges in its brief, see Mot. at 43, standing is more difficult to establish when it rests on vindicating the legal rights or interests of third parties, see, e.g., Whitman-Walker Clinic, Inc. v. HHS, 485 F. Supp. 3d 1, 34 (D.D.C. 2020). Even so, in its 45-page 13 Motion, the plaintiff includes no more than a paragraph and a passing reference to the issue of standing, see Mot. at 15, 43. To issue a ruling on the 13 Motion on April 24, 2025, as the plaintiff seeks, the Court needs additional briefing on the threshold issue of standing. Accordingly, the plaintiff shall file a supplemental brief, not to exceed eight pages, on or before April 21, 2025, at 12:00 p.m. The plaintiff shall address separately for each of its constitutional and APA claims whether it can demonstrate a substantial likelihood of standing necessary to obtain emergency relief. Finally, if the defendants find that they need to exceed the standard briefing page limits to respond fully to the plaintiff's supplemental brief, the defendants shall file an appropriate motion.
