Two U.S.-based law professors challenged the lawfulness of President Trump’s February 6, 2025 Executive Order “Imposing Sanctions on the International Criminal Court” (EO 14203), in which Trump authorized civil and criminal penalties on any U.S. persons who provided services to or for the benefit of certain sanctioned persons. Trump claimed, in the EO, that the International Criminal Court (ICC) had “without a legitimate basis, asserted jurisdiction over and opened preliminary investigations concerning personnel of the United States and certain of its allies, including Israel, and . . . abused its power by issuing baseless arrest warrants targeting Israeli Prime Minister Benjamin Netanyahu and Former Minister of Defense Yoav Gallant.” Trump went on, in the EO, to specifically sanction the ICC’s Prosecutor, Karim Khan, and “any foreign person” who met certain criteria (enumerated at Sec. 1. ii of the EO 14203) by imposing the aforementioned penalties on U.S. persons. The professors alleged that EO 14203 mirrored a previously enjoined 2020 Executive Order “Blocking Property of Certain Persons Associated With the International Criminal Court” (EO 13928) that had sanctioned the then-Prosecutor of the ICC and an official in the Prosecutor’s office. On April 16, 2025, the plaintiffs, two law professors, filed a lawsuit in the U.S. District Court for the Southern District of New York challenging EO 14203. The plaintiffs—one of whom serves as a Special Adviser to the Prosecutor of the ICC—were represented by Foley Hoag LLP and the Open Society Foundations. The professors sued President Trump, the U.S. Department of State, the U.S. Department of Treasury, the U.S. Department of Justice, the Treasury's Office of Foreign Assets Control, and their corresponding agency heads under the Administrative Procedure Act and the Declaratory Judgment Act. The plaintiffs sought declaratory relief that EO 14203 violated the First and Fifth Amendments and exceeded the statutory limits on authority under the International Emergency Economic Powers Act (IEEPA); preliminary and permanent injunctive relief prohibiting the government from enforcing criminal penalty provisions against the plaintiffs; and attorneys’ fees. 

The plaintiffs alleged that EO 14203's prohibitions—violations of which are punishable by civil fines and up to 20 years in prison—forced them to abandon or reassess their speech (e.g., scholarship intended for publication, participation in a podcast, amicus curiae briefs supporting the Office of the Prosecutor, speaking engagements, courses). Thus, the plaintiffs claimed that EO 14203: (1) violated free speech protections under the First Amendment, (2) violated due process under the Fifth Amendment because it lacked notice regarding what acts were punishable and enabled arbitrary enforcement, and (3) exceeded presidential authority under IEEPA by attempting to regulate protected information exchange. 

On April 15, 2025, the plaintiff filed a Statement of Relatedness, alleging that this case is related to another case Open Society Justice Initiative et al. v. Donald J. Trump et. al (1:20-cv-08121-KPF)—in which one of the plaintiffs in this case (Rona) was also a plaintiff—“because of their common parties, claims, and requests for relief.” Notwithstanding the statement, the case was randomly assigned to District Judge Jesse Furman.

On April 16, 2025, the plaintiffs filed a motion for preliminary injunction (PI). While that was being briefed, the parties filed letter briefs regarding consolidation of the motion with a trial on the merits, with plaintiffs favoring immediate consolidation (i.e., an immediate move to final judgment and permanent relief) and the government supporting consolidation but seeking to delay any ruling until after a rulemaking to implement the executive order is published. 

This case is ongoing.

ENDORSEMENT: For the reasons stated in Plaintiffs' letter, see ECF No. 58, the Court is inclined to consolidate the preliminary injunction motion with trial on the merits pursuant to Fed. R. Civ. P. 65(a)(2). It has been more than one month since Defendants represented that related OFAC regulations "are likely to be issued in the near term," ECF No. 57, at 1 n.1, and more than four months since the Executive Order was issued, but no such regulations have been issued. Any objection to consolidation on the merits shall be filed by June 24, 2025. If no objection is filed, the Court will grant the request for consolidation as unopposed and resolve the case on the merits. In the event that the Court proceeds in that manner and related OFAC regulations are issued prior to the Court's final resolution of the case on the merits, the parties could file supplemental submissions addressing the implications of the regulations.
