This case challenged the decision of U.S. Attorney General Pam Bondi, at the instigation of President Trump, to bypass statutorily-required procedures for reassignment of prisoners and transfer 37 inmates to ADX Florence, the harshest unit in the federal prison system. All of these prisoners—21 of whom are the plaintiffs in this case—had previously been serving federal death sentences commuted to life without parole by President Biden on December 23, 2024. This decision prompted then-President-elect Trump to post on social media referencing the 37 commutation recipients and telling them to “GO TO HELL!” On his first day in office, President Trump signed Executive Order 14164, directing AG Bondi to incarcerate these 37 prisoners in a way commensurate with “the monstrosity of their crimes and the threats they pose[d].” Plaintiffs alleged this violated their rights to procedural due process and equal protection, the Eighth Amendment, the Constitution’s prohibitions on bills of attainder and ex post facto punishments, the presidential power to grant clemency, and the Administrative Procedure Act.

Following President Biden’s commutations, the Federal Bureau of Prisons (BOP) commenced its standard reassignment processes for plaintiffs. At that time, BOP determined that each of the plaintiffs was not suitable for transfer to ADX Florence. But after Trump’s executive order, BOP initiated a second reassignment process which predetermined that plaintiffs would be indefinitely moved to ADX Florence, in contrast to BOP’s initial finding that they did not merit incarceration there.

Known as the “Alcatraz of the Rockies,” Colorado’s ADX Florence is the only active ‘supermax’ prison in the U.S. federal system. ADX Florence inmates undergo solitary confinement for 22 or more hours daily in cells specially engineered for sensory deprivation. ADX Florence inmates are permitted just one hour of phone calls per month, eat all meals alone in 7-by-12 foot cells, and may see their access to exercise or recreation suspended for up to three months at a time. Many of the plaintiffs require specialized medical or psychiatric treatment; ADX Florence offers a lower level of healthcare than plaintiffs’ current prison in Terre Haute, Indiana. ADX Florence has limited facilities to accommodate visiting attorneys and limits legal phone calls to just 30 minutes, making it difficult for those incarcerated there to access their legal representation.

Represented by the ACLU, the Center for Constitutional Rights, a student legal clinic at the University of Denver Sturm College of Law, and private counsel, plaintiffs filed this lawsuit on April 16, 2025, in the U.S. District Court for the District of Columbia. The suit named President Trump and AG Bondi as defendants, as well as other DOJ and BOP officials and the BOP itself. Plaintiffs sought a declaration that the defendants acted in violation of the Constitution and the APA, an injunction preventing the enforcement of EO 14164 against them, and an order requiring that any prison reassignment be carried out pursuant to BOP’s statutory requirements. The case was assigned to Judge Timothy J. Kelly.

On May 27, 2025, Judge Kelly denied the plaintiffs a preliminary injunction on the grounds that the Prison Litigation Reform Act requires plaintiff prisoners to exhaust administrative remedies available to them before seeking judicial relief. Judge Kelly noted that any transfers of the plaintiffs to ADX Florence before the conclusion of their administrative appeals, or undue “truncat[ion]” of the appeals themselves, would warrant reconsideration. 2025 WL 1517209.
