This case challenges the U.S. Department of Homeland Security’s (DHS) decision to terminate the F-1 student visa status of multiple plaintiffs by deactivating their Student and Exchange Visitor Information System (SEVIS) records based on criminal record checks. On April 10, 2025, Harun Ozturk and several other international students filed this lawsuit in the U.S. District Court for the District of Columbia against DHS Secretary Kristi Noem. Represented by private counsel, the plaintiffs sought declaratory and injunctive relief to restore their SEVIS records, alleging that the terminations were arbitrary and capricious, violated agency procedures, and unlawfully jeopardized their legal presence in the United States.

The plaintiffs argued that DHS used findings from the National Crime Information Center (NCIC) database to improperly terminate SEVIS records—an action they said automatically disrupted their legal status, barred them from work and school, and exposed them to deportation. They moved for a temporary restraining order (TRO), seeking emergency reinstatement of their SEVIS records during the litigation.

The case was initially assigned to Judge Reggie B. Walton but was later reassigned after the court found it was not sufficiently related to another SEVIS litigation matter, Dogan v. Noem.

On May 5, 2025, U.S. District Judge Carl J. Nichols issued a consolidated ruling in this and two related cases (Badam v. Lyons and Ali v. DHS), denying all plaintiffs’ requests for preliminary injunctive relief.

By that time, ICE had reactivated the SEVIS records for all plaintiffs and issued a new policy excluding NCIC background checks as an acceptable basis for SEVIS terminations. Judge Nichols found that the plaintiffs no longer faced irreparable harm, which is a prerequisite for emergency injunctive relief. He noted that plaintiffs were no longer prevented from attending classes or working, and that any potential future harm was speculative.

Although plaintiffs raised concerns about visa revocation being listed in the new ICE policy as a basis for SEVIS termination, the court concluded that no imminent threat had been demonstrated. Judge Nichols ordered DHS to notify the court immediately if any SEVIS record was terminated again during the litigation.

The case remains ongoing.
