This case challenged the Trump administration’s 2025 suspension and termination of federal funding to Harvard University in response to alleged antisemitism on campus

Harvard filed this lawsuit on April 21, 2025 in the United States District Court for the District of Massachusetts. The University was represented by private counsel. The University named the U.S. Department of Health and Human Services, the National Institutes of Health, the Department of Justice, the Department of Education, the General Services Administration, the Department of Energy, the National Sciences Foundation, the Department of Defense, the National Aeronautics and Space Administration, and their acting agency heads as defendants. 

Upon Harvard’s request, the case was assigned to Judge Allison D. Burroughs and certified related to American Association of University Professors - Harvard Faculty Chapter v. U.S. Department Of Justice.  This case is one of a series of cases brought by Harvard challenging President Trump’s conditioning of federal funds on the University’s adoption of programmatic and structural changes based on alleged failures to address antisemitism. Harvard brought claims under the Administrative Procedure Act (APA), alleging that the termination of funding violated the First Amendment, that the termination exceed the statutory authority of the federal government under Title VI of the Civil Rights Act, and that in terminating the funds the Defendants failed to follow the proper regulatory procedures, as well as two ultra vires (action taken beyond legal authority) claims.

On May 13, 2025, Harvard filed an amended complaint adding two new defendants: the United States Department of Agriculture, the Department of Housing and Urban Development, and their respective secretaries in their official capacities. The amended complaint provided factual updates including the subsequent termination of awards and federal grants from numerous federal agencies. 

Harvard declined to file for preliminary relief. After a status conference on April 28, 2025, both parties agreed to go straight to summary judgment on an expedited briefing schedule. Harvard moved for summary judgement on June 2, 2025. The government moved for cross- summary judgement on June 16, 2025. 

On June 23, 2025, the States of Iowa, Alaska  Arkansas, Florida, Georgia, Indiana, Kansas, Louisiana, Missouri, Montana, Nebraska, North Dakota, Oklahoma, South Carolina, South Dakota, and Texas submitted an amicus curiae brief in support of the government. In the brief, the States wrote that: 

 There are apparently three constant truths in American life: death, taxes, and Harvard University’s discrimination against Jews.

On September 3, 2025, Judge Burroughs granted Harvard's motion for summary judgement as to the following counts:

  • The government's termination of federal funding and threats of future termination was unlawful under the APA because the terminations violate the First Amendment by retaliating against Harvard for unfavored speech and by burdening Harvard’s First Amendment rights through constitutionally impermissible funding conditions. (Count 1)
  • The freeze and termination of federal financial assistance due to allegations of antisemitism were in excess of the government's statutory authority under Title VI and VII of the Civil Rights Act. (Count 3)
  • The government failed to follow regulatory procedures under Title VI (notice of noncompliance and opportunity for a hearing) when terminating the federal funds in violation of the APA. (Count 4)
  • The Freeze Orders were arbitrary and capricious under the APA because the evidence provided by defendants showed there was little investigation done into antisemitism at Harvard and thus there was little rational connection between the Freeze Orders and the explanation provided by the agency. (Count 5, in part) 

Judge Burroughs granted the government's motion for summary judgement in regards to the following counts:

  • The government's actions in imposing viewpoint-based conditions on Harvard's funding and terminating funding agreements violate the First Amendment and lack lawful authority. (Count 2)
  • The Termination Letters were arbitrary and capricious under the APA. The court granted summary judgement on the Termination Letters because these claims fall under the jurisdiction of the Court of Federal Claims. (Count 5, in part)
  • The government's actions contravened Harvard's right to due process and lacked a lawful authority. (Count 6)

The judge granted summary judgment on Counts 2 and 6 because these ultra vires claims were adequately covered by the APA remedies granted. Both motions were otherwise denied. 

The court ordered the following:

  1. The Freeze Orders were vacated and set aside as arbitrary and capricious.
  2. The Freeze Orders and Termination Letters were found to be violative of the First Amendment.
  3.  The Court vacated and set aside the Termination Letters as violative of Title VI of the Civil Rights Act.
  4. The government was enjoined from giving force to the Freeze Orders or Termination Letters. They were enjoined from refusing to grant federal funding pursuant to that order as well. The government was further enjoined from withholding funding from Harvard on purported grounds of discrimination without compliance with the terms of Title VI of the Civil Rights Act.

2025 WL 2528380.

On September 10, 2025, Harvard voluntarily dismissed their last two claims under the APA regarding the Spending Clause and 5th Amendment Due Process, effectively resolving all the claims in the lawsuit. The parties filed a status update on September 19, 2025 indicating the parties are working to implement Judge Burroughs’ order, with the next status report due on October 3, 2025.

This case is currently ongoing.
