On February 18, 2025, Holy Sexuality, a Christian nonprofit, filed a lawsuit against software company Asana after the company did not give Holy Sexuality a 50% discount Asana offered to nonprofits. The plaintiff alleged that the defendant had a policy barring religious nonprofits "that exist to solely propagate a belief in a specific faith" from receiving the discount. The plaintiff brought the case under California’s Unruh Civil Rights Act (Cal. Civ. Code § 52), which prohibits businesses from discriminating on the basis of religion and other protected characteristics.
The plaintiff was represented by private counsel and the Alliance for Defending Freedom. The case was filed in the U.S. District Court for the Southern District of California. The case was initially assigned to Judge Thomas J. Whelan, but was reassigned to District Judge Andrew G. Schopler on February 21, 2025.
The plaintiff sought a declaratory judgement that the defendant's policy and its application to the plaintiff constituted religious discrimination prohibited by California’s Unruh Civil Rights Act. The plaintiff also sought an injunction prohibiting Asana from “enforcing, publishing or advertising its Religious Discrimination Policy or any materially similar policy,” as well as general and special damages and attorneys fees.
Shortly after filing this suit, the parties settled and the case was voluntarily dismissed on April 16, 2025. As part of the settlement, Asana agreed to give Holy Sexuality the 50% discount it offered to other nonprofits and agreed to remove the religious discrimination language from its policy and website.
