This case challenges a grant termination that allegedly threatens the independence of a professional association; it tests the limits of executive authority in awarding and withdrawing federal funds. On April 23, 2025, the American Bar Association (ABA) filed this lawsuit in the U.S. District Court for the District of Columbia against the U.S. Department of Justice (DOJ). The ABA alleged that the DOJ unlawfully terminated $3.2 million in grants that supported training for lawyers assisting victims of domestic and sexual violence. The DOJ revoked the funding on April 10, 2025, just one day after Deputy Attorney General Todd Blanche issued a memorandum prohibiting DOJ attorneys from attending or participating in ABA-sponsored events. That memorandum accused the ABA of promoting “activist causes” that were allegedly inconsistent with the department’s mission. The ABA claimed that the DOJ’s action was retaliatory, in response to the ABA’s public criticism of the Trump administration, thereby violating the First Amendment and the Administrative Procedure Act. The case was assigned to U.S. District Judge Christopher Cooper.

Represented by public interest attorneys at Democracy Forward, The ABA sought both declaratory and injunctive relief, requesting both an interim and permanent orders blocking the DOJ’s cancellation of the grants, reinstating the funding, and preventing the DOJ from taking similar actions in the future. The ABA emphasized that the loss of funding had already caused significant harm, including staff layoffs and reduced capacity to serve survivors of gender-based violence.

On May 2, 2025, the defendants moved to dismiss the case. 

On May 14, 2025, he granted a preliminary injunction, temporarily blocking the DOJ from canceling the grants, stating that the ABA's First Amendment injury was "concrete and ongoing." 2025 WL 1388891.

On July 17, 2025, the case was administratively closed and the defendant's motion to dismiss was stricken. The parties were directed to file another status report by October 1, 2027, unless earlier developments required a new filing.
