This case is one of numerous lawsuits challenging the Trump administration’s abrupt termination of immigration visas—mostly student or work visas—with no notice to the visa-holders and with dubious or no legal basis. You can see all of the cases here.

On April 15, 2025, an international student—attending school on an F-1 visa--filed this lawsuit in the United States District Court for the District of Columbia against the Secretary of Homeland Security. In early April, the Defendants abruptly terminated the Plaintiff’s, and other international students’, F-1 visa and records with the Student and Exchange Visitor Information (SEVIS), effectively stripping them of their ability to remain a student in the United States. The Plaintiff alleged that Defendants' actions were unlawful and designed to coerce them and other international students into abandoning their studies and self-deporting. This case was assigned to District Judge Reggie B. Walton.

Plaintiff promptly moved for a temporary restraining order, and on April 18, Judge Walton partly granted an order restoring the plaintiff's SEVIS record and demanding additional information from the government. Following additional motion practice, however, upon the government's representation of a new policy that would restore plaintiff's status and ensure that the SEVIS record was not again deleted based on an alleged minor criminal history entry, the court sue sponte ordered the case dismissed without prejudice on April 25. The case is now closed.

ORDER. In accordance with the attached Order, and in light of the 2 Plaintiff's Motion for Temporary Restraining Order and the discussions the Court had with counsel for the parties at the April 18, 2025, motion hearing, it is hereby ORDERED that the 2 Plaintiff's Motion for Temporary Restraining Order is GRANTED IN PART AND HELD IN ABEYANCE IN PART. The motion is GRANTED to the extent outlined in this Order, and in accordance with the oral rulings issued by the Court at the April 18, 2025, motion hearing. The motion is DENIED in all other respects. It is therefore ORDERED that the defendant shall treat the plaintiff as it would have treated the plaintiff prior to the defendant's termination of her record in the Student and Exchange Visitor Information System ("SEVIS"), preserving the status quo until a further hearing on the 2 Plaintiff's Motion for Temporary Restraining Order, currently scheduled for April 21, 2025, at 1:00 p.m. It is further ORDERED that the defendant shall ensure the attendance at the motion hearing currently scheduled for April 21, 2025, of a representative of the United States Department of Homeland Security ("DHS") who can make authoritative representations to the Court on behalf of the agency. Specifically, the representative should be prepared to explain to the Court what impact the agency's SEVIS termination has on the lawful status of students, including the plaintiff, who are studying in the United States, and if such terminations were not intended to have the impact that educational institutions are interpreting the agency's action to have (i.e., revocation of SEVIS-terminated students' authorization to lawfully continue their studies or training in the United States), why the agency has not taken action to communicate that misalignment with the educational institutions hosting these students. It is further ORDERED that, by 11:00 a.m. on April 21, 2025, the defendant shall file evidence of the plaintiff's alleged criminal history record, with the Washington Metropolitan Police Department, for Simple Assault. Signed by Judge Reggie B. Walton on April 18, 2025. (lcrbw3) Modified on 4/24/2025. (zalh) (Main Document 7 replaced on 4/24/2025) (zalh). (Entered: 04/18/2025)

ORDER. In accordance with the attached Order, and in light of the 2 Plaintiff's Motion for Temporary Restraining Order, and the parties' representations at the April 25, 2025, motion hearing, it is hereby ORDERED that the 2 Plaintiff's Motion for Temporary Restraining Order is GRANTED IN PART AND HELD IN ABEYANCE IN PART. The motion is GRANTED to the extent outlined in this Order, and in accordance with the oral rulings issued by the Court at the April 18, 2025, and April 25, 2025, motion hearings. The motion is HELD IN ABEYANCE in all other respects. It is therefore ORDERED that the defendant shall continue to treat the plaintiff as it would have treated the plaintiff prior to the defendant's termination of her record in the Student and Exchange Visitor Information System ("SEVIS"), preserving the status quo until either a further hearing on the 2 Plaintiff's Motion for Temporary Restraining Order currently scheduled for April 28, 2025, at 12:00 p.m., or the plaintiff's SEVIS record is reinstated to "active" status, whichever comes first. It is further ORDERED that, if the plaintiff's SEVIS record has not been reinstated by the defendant to "active" status by April 28, 2025, at 12:00 p.m., the parties shall appear before the Court at that date and time for a further hearing on the 2 Plaintiff's Motion for Temporary Restraining Order, via teleconference. The parties shall appear before the Court by calling 646-828-7666, entering the Meeting ID 161 591 8885 followed by the pound key (#), and then entering the Passcode 984979 followed by the pound key (#). It is further ORDERED that, if the plaintiff's SEVIS record has not been reinstated by the defendant to "active" status by April 28, 2025, at 12:00 p.m., the defendant shall ensure the attendance at the motion hearing currently scheduled for April 28, 2025, of a representative of the United States Department of Homeland Security ("DHS") who can make authoritative representations to the Court on behalf of the agency. Specifically, the representative should be prepared to explain to the Court what impact the agency's SEVIS termination has on the lawful status of students, including the plaintiff, who are studying in the United States, and if such terminations were not intended to have the impact that educational institutions are interpreting the agency's action to have (i.e., revocation of SEVIS-terminated students' authorization to lawfully continue their studies or training in the United States), why the agency has not, to date, taken action to communicate that misalignment with the educational institutions hosting these students. It is further ORDERED that, consistent with representations made during the April 25, 2025, hearing, upon the reinstatement of the plaintiff's SEVIS record to "active" status by the defendant, the plaintiff shall file a notice of voluntary dismissal, unless the plaintiff concludes that doing so would be inappropriate, despite those representations made.
