This case involves one of many federal government challenges to sanctuary city laws. Rochester’s sanctuary laws prohibit city employees from assisting in federal immigration enforcement. The United States alleged that Rochester's laws violated 8 U.S.C. § 1373, which is a cause of action that pertains to obstructing communication to and from the Immigration Naturalization Services. The U.S. also alleged that Rochester’s sanctuary laws violated the Supremacy Clause. 

The U.S. filed the lawsuit on April 24, 2025, in the U.S. District Court for the Western District of New York.  The case was assigned to District Judge Frank P. Geraci, Jr. The complaint alleged that Rochester's sanctuary laws violates the Supremacy Clause in three ways. First, the U.S. alleged that Newark’s sanctuary laws are in conflict with federal law, and that federal law must preempt local law. Second, the U.S. alleged that Newark’s law unlawfully regulating the federal government. Finally, the U.S. alleged that Newark’s provisions discriminated against the federal government by singling out federal immigration authorities for disfavored treatment. The U.S. sought declaratory and injunctive relief.

The defendants filed a motion for judgment on the pleadings on June 4, arguing that Rochester's policies do not conflict with any federal law but "simply recognize[] that the law does not require local governments to collect immigration status information or to engage in immigration enforcement." On July 8, the U.S. filed a cross-motion for judgment on the pleadings, arguing that Rochester's policies restrict information sharing in violation of federal laws. 

The case is ongoing.
