This case was brought by the Trump Administration Department of Justice, seeking to compel the City of Rochester, NY, to drop its "Sanctuary City" policies. The case arose out of an incident on March 24, 2025, when local police officers in Rochester, New York assisted Department of Homeland Security officers in detaining three people during a traffic stop, one of whom was charged with illegal entry into the U.S.

Rochester declared itself as a sanctuary city in 1986 and reaffirmed that commitment during President Trump’s first term when it passed a 2017 resolution that states that police “shall not engage in certain activities solely for the purpose of enforcing federal immigration laws, including not inquiring about the immigration status” of crime victims or witnesses unless needed for a criminal investigation. It also prohibits city employees from assisting in federal immigration enforcement. Rochester's mayor responded to the March 2025 incident by stating, “Our policy clearly states that the Rochester Police Department is not responsible, and does not engage in the enforcement of immigration laws.”

Specifically, the U.S. alleged that Rochester's laws violated federal law "by forbidding Rochester police officers from communicating with ICE or CBP regarding a detainee, including the detainee’s custody status, immigration status, release date, or the like." In order "to facilitate coordination between state and local officials and the Federal Government, Congress expressly prohibited any federal, state, or local government entity or official from prohibiting, or in any way restricting, any government entity or official from sending to, or receiving from, DHS information regarding the citizenship or immigration status, lawful or unlawful, of any individual." However, the U.S. argued that Rochester's policies would violate that command. 

The U.S. filed the lawsuit on April 24, 2025, in the U.S. District Court for the Western District of New York.  It said that Rochester's policy violates the Constitution's Supremacy Clause in three ways: First, by passing laws in an area preempted by federal regulations; second, by unlawfully discriminating against the federal government; and third, by unlawfully regulating the federal government. The U.S. sought a judgment declaring the policy invalid and preliminary and permanent injunctions prohibiting the city from enforcing the policy. 

The case was assigned to District Judge Frank P. Geraci, Jr. The defendants filed their answer to the complaint on May 21. The defendants also filed a motion for judgment on the pleadings on June 4, arguing that Rochester's policies do not conflict with any federal law but "simply recognize[] that the law does not require local governments to collect immigration status information or to engage in immigration enforcement." Also on June 4, the Ibero-American Action League, Western New York Coalition of Farmworker Serving Agencies, Third Presbyterian Church, and New Hope Free Methodist Church moved to intervene in the case as defendants. However, the court denied the motion to intervene on July 23, finding that permission to appear and file briefs as amici curiae was sufficient to protect the intervenors' interests. 

On July 8, the U.S. filed a cross-motion for judgment on the pleadings, arguing that Rochester's policies restrict information sharing in violation of federal laws. The defendants' response to the motion is due on August 5, 2025.
