This case challenged the Trump Administration's removal of two members of the National Credit Union Administration (NCUA). This case challenged the Trump Administration's removal of two members of the National Credit Union Administration (NCUA). On April 28, 2025, NCUA Chairman Todd Harper and board member Tanya Otsuka filed suit in the U.S. District Court for the District of Columbia against the Secretary of the Treasury, the Executive Director of the NCUA, the new Chairman of the NCUA, the Deputy Assistant to President Trump, and President Trump himself. Todd Harper was appointed for a partial term to the NCUA during President Trump's first term and was later nominated by President Biden and confirmed by the Senate to serve a full six-year term as the board's Chairman. President Biden also nominated, and the Senate later confirmed, Tanya Otsuka to serve on the NCUA board. On April 15, 2025, both plaintiffs received brief emails from Trent Morse, the Deputy Assistant to the President and Deputy Director of the White House Presidential Personnel Office, stating that their positions had been terminated.

The plaintiffs alleged that they had been fired in violation of the President's statutory authority, since under 12 U.S.C. § 1752a(c), once confirmed by the Senate, members of the board are removable only "for cause"; that under the Administrative Procedure Act any actions taken by the board while they were unable to participate would be unlawful and should be set aside; and that the President's actions were a violation of the Constitution's separation of powers principles. Represented by private counsel, plaintiffs asked for declaratory and equitable relief as well as their attorneys' fees. The next day, on April 29, the plaintiffs filed a motion for a preliminary injunction and a motion for summary judgment. 

The case was assigned to District Judge Amir H. Ali. On April 29, the plaintiffs filed a motion for a preliminary injunction and a motion for summary judgment. The defendants then filed a cross-motion for summary judgment and opposition to the plaintiffs' motions for summary judgment and a preliminary injunction on May 9. The court heard argument on the dispositive cross-motions on June 12.

The court granted the plaintiffs' motion for summary judgement on July 22, 2025, finding that "the text and history of the NCUA statute, along with the structure and function of the NCUA Board, confirm Congress restricted the President’s power to remove Board members." 2025 WL 2049207. The court also held that the removal restriction was constitutional under the Supreme Court's decision in Humphrey's Executor, where the Court upheld the structure of the FTC as constitutional since it was a multimember expert agency that did not wield substantial executive power. Here, the court found that the NCUA is a multimember board that "does not exercise the kind of substantial executive power that would warrant a departure from Humphrey's Executor." The court claimed that if "the NCUA Board exercises substantial executive power, it is difficult to see how the same would not be true of the Federal Reserve." 

Turning to remedy, the court found that the appropriate remedy was a declaratory judgment finding the terminations unlawful and a permanent injunction ordering reinstatement of the fired board members. 

The defendants filed a motion to stay the injunction pending any appeal and appealed the case to Court of Appeals for the District of Columbia Circuit on July 23, asking for an immediate stay and for a stay pending appeal. The district court denied the motion on July 24, but on July 25, the Court of Appeals granted an administrative stay pending the result of any appeal. 

On September 22, the following states filed an amicus brief for the appellants: Arizona Legislature, State of Alabama, State of Alaska, State of Arkansas, State of Florida, State of Georgia, State of Indiana, State of Kentucky, State of Louisiana, State of Mississippi, State of Missouri, State of Montana, State of Nebraska, State of North Dakota, State of Ohio, State of Oklahoma, State of South Carolina, State of South Dakota, State of Tennessee, State of Texas, State of Utah and State of West Virginia.

 The court ordered this case be held in abeyance pending the Supreme Court’s disposition of Donald Trump, et al. v. Rebecca Slaughter. The government filed a petition for a writ of certiorari on September 25, 2025.
