This case challenges Orange County, New York’s alleged policies and practices at the County Sheriff’s Office and Orange County Jail that burdened a Muslim woman’s religious exercise.

The plaintiff is a Muslim woman incarcerated at Orange County Jail. She alleges that the county officers repeatedly compelled her to remove her hijab for official purposes, confiscated or damaged religious property, and failed to accommodate religious dietary observance.

Plaintiff alleges that on February 2, 2024, predominantly male officers forced her to remove her hijab for booking photographs and then kept her uncovered for roughly 12 hours while she awaited arraignment. She further alleges she was kept uncovered during transport to and while present in court, and that later the same day officers required a second hijab-less photograph for her jail identification card. She claims she then had to use and repeatedly present an ID card displaying an uncovered photo multiple times per day for months, which she describes as ongoing humiliation and a continuing burden on her faith. She alleges she filed multiple grievances during 2024 and was ultimately allowed to take a new covered ID photo in late October 2024, but contends the earlier uncovered images remained in county systems.

She also alleges repeated confiscation and interference with religious items. Plaintiff claims her hijab was taken during the February 2024 processing and not returned for weeks until a Muslim chaplain provided replacements. She alleges that on August 20, 2024, following a verbal complaint the prior day about recreation time, officers conducted a targeted cell search, refused to let her put on her hijab before ordering her out, confiscated her hijabs and Quran, and broke her prayer beads, leaving her uncovered and unable to pray for an extended period. She alleges she faced delays or obstacles obtaining grievance forms, that her grievance was denied on September 3, 2024 on an allegedly false factual premise, and that her appeal was denied without explanation. Plaintiff further alleges that on January 18, 2025, officers conducted another search and she later found her Quran tossed on the ground and stepped on, her religious notes torn, and her prayer beads taken; she alleges her grievance (filed January 19, 2025) was denied (January 28, 2025) and her appeal denied the next day without explanation. She also alleges problems with religious diet and Ramadan observance in March 2025, including meals inconsistent with her restrictions, missed pre-dawn meals and medication, and long periods without food that allegedly caused illness and the loss of a jail work assignment. Finally, she alleges that on April 1, 2025, officers removed a spare hijab during a unit search and never returned it, and that she again encountered obstacles pursuing a grievance.

On April 21st, 2025, Plaintiff filed this lawsuit against Orange County and multiple named and unnamed officers in the U.S. District Court for the Southern District of New York, seeking a jury trial. As pleaded, she asserts federal claims under 42 U.S.C. § 1983 for violations of the First and Fourteenth Amendments, failure to intervene, municipal liability, and retaliation, as well as a RLUIPA claim against the County and a New York law claim for negligent training and supervision.

Represented by the Council on American-Islamic Relations (CAIR), Plaintiff sought compensatory damages, punitive damages against individual defendants, and injunctive relief requiring destruction of hijab-less photographs (and related footage) from County databases and policy changes barring hijab removal for booking or identification photos, along with attorneys’ fees and costs. The case is assigned to Judge Nelson Stephen Roman.

On June 9, 2025, Plaintiff filed an amended complaint. It added a new, specific section alleging that Orange County had a broader custom or practice of forcing religious head coverings off for photographs, supported by allegations about at least four other women and Ms. Green’s own prior bookings; it expanded the August 2024 and January 2025 retaliation allegations by adding facts about who overheard Ms. Green’s complaints, who was allegedly aware of them, and that a correction officer appeared to step on the Quran, tear religious notes, and act after learning of counsel’s demand letter. It also replaced the original second claim under the New York Constitution with a federal failure-to-intervene claim.

On September 15, 2025, Orange County filed a motion to dismiss. The Court has not reached a decision.

The case is ongoing.

Mullins, and Officers Narcise and Lattimer's (the "County Defendants") letter dated July 21, 2025 requesting a pre-motion conference related to an anticipated motion to stay discovery (ECF No. 44) (attached hereto). The Court is also in receipt of Plaintiff's letter dated July 24, 2025 in response (ECF No. 46) (attached hereto). The Court waives the pre-motion conference and sets the following briefing schedule: (1) The County Defendants' moving papers are to be served (not filed) on August 27, 2025; (2) Plaintiff's opposition papers are to be served (not filed) on September 26, 2025; and (3) The County Defendants' reply papers are to be served on October 13, 2025. All motion papers are to be filed on the reply date, October 13, 2025. The parties are directed to provide Chambers with two physical courtesy copies of their motion papers on the same date they are served on opposing counsel. The parties are further directed to provide the Court with an electronic courtesy copy of the motion papers as they are served per this Court's local emergency civil rules.
