This case raises a challenge to cuts in government funding for university research. On May 5, 2025, 13 public and private universities and three associations of universities sued the National Science Foundation (NSF) and its acting director in the District of Massachusetts, challenging cuts to "indirect cost rates" for NSF-funded research grant formulas. While direct costs are those directly attributable to a specific project, indirect costs are costs necessary for research but are not directly attributable to a specific project. On May 2, 2025, NSF issued a policy stating that "NSF will apply a standard indirect cost rate not to exceed 15% to all grants and cooperative agreements awarded to [universities] for which indirect costs are allowable." Previously, the agency "exercised its authority to promulgate regulations requiring agencies to negotiate indirect cost rates with individual funding recipients through a carefully regulated process based on each institution’s unique needs and cost structure." "The purpose of this process is to ensure that the negotiated rate correctly captures the actual indirect costs incurred in the conduct of research." However, the new policy would remove the negotiation aspect of the process, instead imposing a blanket cap on indirect cost grants.  

Represented by private counsel, the plaintiffs raised several claims under the Administrative Procedure Act. First, the plaintiffs argued that the Rate Cap Policy was contrary to law, since Congress did not expressly authorize the agency to enact such a sweeping change, and the "Supreme Court has underscored that agencies may not enact sweeping rules of this sort without express congressional authorization." Second, the plaintiffs argued the policy was contrary to law because the applicable regulations "do not authorize NSF to make a unilateral decision to impose an arbitrary cap on the rate applicable to all universities that does not attempt to approximate actual indirect costs." Finally, the plaintiffs alleged that the policy was arbitrary and capricious. The plaintiffs asked the court to vacate the policy, to declare it unlawful, and to enjoin the defendants from taking steps to implement the policy. 

The case was assigned to District Judge Indira Talwani. On May 8, the plaintiffs filed a combined motion for preliminary injunction and for summary judgment. The defendants filed a cross-motion for summary judgment on May 27. Judge Talwani granted the plaintiffs' motion for summary judgment on June 20, denying their motion for a preliminary injunction as moot. The court first found, contrary to the defendants' arguments, that the plaintiffs had shown standing based on an "imminent and substantial" future injury. "Qualifying for less federal funding is a future injur[y] that is sufficient to confer standing where the threatened injury is certainly impending, or there is a substantial risk that the harm will occur." The court found it sufficiently likely that one of the plaintiffs would qualify for less funding under the Rate Cap Policy. Second, the court held that the Rate Cap Policy was reviewable under the APA, since "statutory standards cabin the agency’s exercise of the discretion Congress has given it," and regulations "dictate when and how NSF may deviate from negotiated indirect cost rates." 

Turning to the merits, the court found that the statutory text and executive interpretations of relevant statutory sections supported plaintiffs' claim that the NSF cannot implement a 15% Indirect Cost Rate. The court also ruled that with the Rate Cap Policy, "NSF has rejected the regulatory framework for funding indirect research costs and has limited the recovery of actual costs by imposing a de minimis rate 
on IHEs with [previously] negotiated indirect cost rates." Finally, the court held the policy to be arbitrary and capricious, since the Policy Notice in which NSF laid out the Rate Cap Policy expressed goals that the agency hoped to reach but failed to explain how the policy would assist the agency in reaching those goals. 

Based on its findings, the court vacated the Rate Cap Policy and issued a declaratory judgment finding the policy unlawful, but the court refused to issue a permanent injunction, since it decided that vacatur of the policy and the declaratory judgment provided the plaintiffs with adequate relief.  The court entered final judgment that same day. 

The case is ongoing.
