This case challenged the possible termination of Temporary Protected Status (TPS) for nationals of Afghanistan and Cameroon. This case challenged the possible termination of Temporary Protected Status (TPS) for nationals of Afghanistan and Cameroon. On May 7, 2025, CASA, Inc. filed this lawsuit in the United States District Court for the District of Maryland against the U.S. Department of Homeland Security and its Secretary. The Plaintiff challenged the Defendants' reported attempt to terminate the TPS designations for Afghanistan and Cameroon. The Plaintiff alleged that the manner of these terminations violated the Administrative Procedure Act. The case was assigned to District Judge Theodore D. Chuang.

Also on May 7, the plaintiff filed a motion for partial summary judgment and to stay the termination, on which the court set an expedited briefing schedule. However, on May 9, the parties filed a joint status report indicating that the government had pledged any change to TPS status would be effective no less than 60 days after a Federal Register publication and that, consequently, the litigation could be paused until plaintiffs filed an amended complaint no more than 7 days after such publication.

On May 20, 2025, plaintiffs filed an amended complaint adding two additional Afghan CASA members as parties, as well as claims under the Equal Protection Clause and the Declaratory Judgment Act. That same day, they moved for partial summary judgment on Counts I through IV of the amended complaint or, in the alternative, postponement of the effective date of the termination of Afghanistan's TPS designation until 60 days after final judgment was entered. 

On June 3, defendants filed a motion to dismiss and a cross motion for partial summary judgment, arguing that the court lacked jurisdiction to review the Secretary of Homeland Security's TPS determinations. Two days later, plaintiffs filed a supplement to their amended complaint, adding supplemental claims under the APA and Equal Protection Clause related to Cameroon. 

On July 10, the Court denied both parties' motions for partial summary judgment. The Court denied Defendants' motion, finding that judicial review was not barred under 8 U.S.C. § 1254a(b)(5)(A) and that injunctive relief was not precluded under 8 U.S.C. § 1252(f)(1). The Court denied Plaintiffs' motion on the grounds that genuine disputes of material fact remained and the factual record was insufficiently developed. The Court also denied Plaintiffs' request for a stay, concluding that they had not demonstrated a sufficient likelihood of success on the merits. 

On July 14, 2025, Plaintiffs filed an appeal to the U.S. Court of Appeals for the Fourth Circuit. That same day, they filed an emergency motion for injunctive relief pending appeal. The Fourth Circuit granted an administrative stay of agency action related to the termination of TPS status for Afghanistan until July 21, 2025, at 11:59 p.m. 

On July 21, the Fourth Circuit denied Plaintiffs' motion to postpone agency action pending appeal, concluding that the evidentiary record did not support the requested relief. They encouraged the District Court to proceed expeditiously in order to minimize the uncertainty likely to result from prolonged litigation. The following day, Plaintiffs filed a motion to dismiss the appeal.  

The case is ongoing.
